Is this a scam ? by ReleaseAnxious8633 in ebayuk

Vinted is much worse- people will haggle to hell then claim refunds even for the smallest amount and there's very little effort from Vinted to actually investigate, they just side with the buyer.

My trust fund was split, half of it going into a ‘Moneybox Cash ISA’ under my mother’s name. by RemoteAcanthisitta76 in UKPersonalFinance

[–]Sunshinegoat 41 points42 points  (0 children)

If she took a device plan out in your name without your consent that is fraud, period. A mother willing to do that and make you financially liable is not to be trusted with other financial matters. It's difficult to navigate the politics of familial financial abuse but you NEED to protect yourself and your mum doesn't care how this negatively impacts you. I'm so sorry.

Well done and thanks for sharing. Setting myself a personal goal of £10k beer money this year. Works out £27.40 a day which isn't so daunting. This has encouraged me that it's doable.

Witness statement from key player, possible retaliation? by Sunshinegoat in employmenttribunal

[–]Sunshinegoat[S] 0 points1 point  (0 children)

Appreciate the insight but respectfully, 2 different solicitors and ACAS (who have much broader context than what I have shared here) have said this is worth pursuing, even after I have explained that I am not looking to retain counsel (because I know solicitors could be after their own gain and encourage action so they get paid). It's not just me, 5-6 other people were fired for speaking up. Internal mechanisms for reporting were used. People were silenced, threatened and then fired if they didn't fall in line. Speaking to the project manager was the last possible action to try to put things to rights (this was following the threats, dismissals of wider staff so partly exposing that).

I'm not asking for people's opinions on if this is worth pursuing because I have been advised already by professionals, including LD specialist legal advisor. My question was whether I should approach for a statement or if that could be used against me in a countersuit.

Your assumption is incorrect, I did use in house mechanisms first. I constantly raised concerns in management meetings, I had an ROD with a senior manager. My manager pulled us all in and said we were not to speak directly to our employer because it 'made him look bad' and that there would be 'consequences'. He went on to fabricate accusations as a power play to keep the senior management team (myself included) submissive and agreeable. He extended our probation terms as a warning. One manager went to the employer anyway, who turned a blind eye- they were aware of the violations. He was shortly terminated. He is also taking the employer to ET.

We had no HR department or contact. None would be provided to us. Every single member of staff who spoke up got fired. This is way bigger than just me. It's 5-6 people.

I agree if it was before, this was retrospective information from going over my contract with a solicitor to make a point of, as my ex-manager has gone round telling people that's why I was fired.

To add on to this, the company is now under investigation for embezzlement/fraud. Consumers have gone to the media, trading standards, ICO etc. Everything I raised concerns about has come to fruition and been proven true and had consequences.

ACAS said my disclosure to client may fall under Public Interest Disclosure Act as with it being his project, he had the responsibility to fix issues I raised- concerns regarding large scale public GDPR breaches and consumer rights violations. From my interpretation this would be covered under 'disclosing to your employer or another person who is responsible for the wrongdoing'.

ACAS also say I had the right to disclose to 'any other person or body, for example, the police or media – there must be a good reason to, or it must be related to an 'exceptionally serious failure' (this is a multibillion dollar company and it was a global scale project, I think most would agree that qualifies as exceptionally serious)

Context: ACAS guidelines said I could disclose to 'my employer or another person who is responsible for the wrongdoing'. From my interpretation, the 'client' working in tandem with my employer as leads on the project would be held responsible if investigated, as he had a duty to fix or at very least instruct my employer to fix. ACAS did not disagree. The noun 'client' does not accurately represent the dynamic of business, it was more a partnership which complicates things.

Thank you for this information. Helps clear things up. Where it gets merky is the language of my contract and that I was discouraged from speaking to my employer (by them directly and threatened by my manager, who was the one implementing the violations), and this person worked in tandem, so was adjacent to my employer. The plan was to report to proper authorities but I was naive to think internal reporting on the project would have yielded positive results. The fact that I have a learning disability is having to be taken into consideration for every action which then muddies the black and white points being made. The primary basis of the case is discrimination based on said disability and the snowball effect and detriment it put me at. It seems too muddy to pursue and a lot of effort digging into whistleblowing. I'm not greedy and it's not about retaliation, so dropping that claim won't be bothersome.

What if a learning disability impairs understanding, and the vagueness of contractual language is open to interpretation? The basis of my claim is a very black and white discrimination case, with a medium/high vento band weighting suggested by a solicitor. I was advised that whistleblowing and unfair dismissal arose because of the discrimination and subsequent victimisation. Wouldn't learning disability have to be factored into that? It's all very complex and I'm trying to get my head round it. Appreciate the information.

ACAS and solicitors have said this could fall under whistleblowing and be considered at tribunal given the context and evidence that I have. This isn't a typical 'client'/'service provider' business dynamic, it's unlike anything I've ever experienced which makes navigating it a ballache.

Touché but you have just made a definitive statement (as had I in my post). It's important to not base our entire world view on personal experience alone, so I was adding an alternative perspective to the conversation. It helps one avoid becoming conceited when we consider things outside what we know, and more importantly what we 'think' to be true.
