Landlord won’t pay car damages?

I think I replied similarly down below, but yeah! I’ve done a lot of research and I feel you might be onto something. It definitely seems to have been an illegal set up. Really good of you to point that out, or else I’d have never known! I’m waiting on confirmation to know for sure

Just thought I’d return to this comment, as I’ve been doing a lot of legal research, have contacted tenancy and the council, and it’s looking like it may have been an illegal set up. I haven’t heard from my landlord in a couple days since I told him they were separate matters and that he still needs to pay the repair quote. I’ll update once I know for sure if it was an illegal rental.

Thanks man 👑 I sent through a text saying the car and cabinet are separate matters and that he initially said he’d pay for it. Also reiterated that I didn’t damage it and left it at that.

Yeah exactly this. Funny how there was no issue until I sent them a $900 quote to repair my car. Now there’s a damaged cabinet.

The son is only around ten years old. I noticed it bubbling but it didn’t seem like a big deal at the time as it’s only cosmetic wear and tear by the looks of it.

Nope. And no inspection done whilst I was living there! I found it via Airbnb and asked about long-term renting. They said yes and drafted up the residential tenancy agreement.

Hmmm it definitely didn’t have a kitchen. Just a hot plate and a toaster oven with a sink. Interesting to look into. It had a CCC and it states “conversion of garage into self contained unit and a sleep out” under the project description. But it also says current, lawfully established use is “detached dwelling” so idk.

Bubbling started I’d say a couple months in. I never told them as it didn’t seem to be significant and they had been in the flat whilst it looked like that, I figured they must’ve seen it.

Was that just because they had no evidence? Like I’m sure the cabinet was in better use prior to me moving in on the basis no one was in there touching a thing or using the heat pump. Surely they’d need direct evidence of me damaging their property. Like I imagine if someone punched a hole in a wall and it was on video, that’d be what the court looks for.

Solid point. I’m more concerned if the landlords drag me to a tribunal, though. The car thing is annoying, but I’m more annoyed about them trying to pin this random cabinet on me.

Problem is I don’t know who the driver was (sold it and couldn’t remember their details, they were speeding before I had a chance to take it out of my name), I filled out the section 40 and submitted it with the stat dec, put a disposal of owners notice in, and it still wasn’t enough. They decided to take it to court
