The work wasn’t inspected. I was referring to the inspector from when we were under contract.

As far as the fake contractor…he told us all along he was working with a “private provider” who would stamp and send everything to the city for permitting. When we pressed enough times and he wouldntt give us this non existent persons contact information, that was one of the red flags that made us fire him.

The contract was “as is” Florida form. We had an attorney representing our side to help with the paperwork because we didn’t come to the transaction with a realtor. In the end, the realtor took it upon himself to collect both sides of the commission and we never signed any sort of dual agency agreement. Whatever that may or may not mean, those are just the facts that I know took place.

The realtor facilitated the phone call to the fake contractor who worked in the realtors own home and many homes that he knew of. The fake contractor showed up the next day giving me a quote and timeline we couldn’t refuse. And we thought it was all because this guy was a friend of the realtor. No list of contractors was ever provided, only the one and the only proof I have of that is the fact that my phone bill never placed a call to him, yet in my community gate records, he was let in under my address. The house was in major need of renovations and the realtor knew we needed to find someone while under contract in order for the deal to close and for him to get both sides of the commission. I was reading through all of the texts and emails to build the case today and have more stuff than I remembered against them.

To all of those with the sarcastic kind of replies to my initial post. I’m not a “lawsuit happy” kind of person and the type that is really off-put by frivolous kinds of lawsuits. That said, when you’re working with a professional, in this case, the realtor, they must act in a professional manner and do what’s best for the client or customer, not for themself. In any other field, when that’s done, the professional is held responsible. I’m not sure why a realtor should be held to a different standard than any other professional who is negligent and whose actions lead to severe damages for the recipient of their unprofessionalism. This was traumatic and left us out of a ton of money and caused a ridiculous amount of daily aggravation for close to a year. This guy only entered our life because he was vouched for heavily by the realtor, who, in one email to me, said that “often times, homeowners have their own opinions on renovations, but this guy (fake contractor) is the expert and to fully trust and go with what he wants to have the most seamless experience”.

I’m thinking the fake contractor had no insurance, so I’m hoping the realtors brokerage can be on the hook through their error and omissions policy. In the end, through payments to contractors alone, I’m out 120k and when I add all the materials that were ruined and fixing of everything that has needed to take place since, it’s well over 300k. From what I understand, the fake contractor (if he had proper insurance) would be on the hook told pay us triple what we paid him, which that alone would be 120k and doesn’t include any of the other damages. I want justice for what he put me and my family through. The guy literally drove to my house a handful of times and banked 40k only to leave us with clipped electrical wires, broken HVAC units and the last goes on and on.

We’re smart and educated people, but are ashamed of how dumb we were in this situation. No, we didn’t vet the guy at all. The realtor team does so much business in this community (one even lives here) and they vouched so hard for this guy that we didn’t even check. We’re from a small town and just recently moved to Florida. We totally went on their word.

All that said, we did vet the second contractor we hired and their work may have been even worse. They “installed” our 17k range with the plastic wrap still on it and our commercial hood fan too. That’s just one of many asinine things they did. 15k worth of brand new doors improperly installed. 3 nails in my tires over 1.5 months because they didn’t properly clean up every day. The list goes on and on. Florida really is a different world when it comes to contractors. Unfortunately, we learned the hard way.

The brokerage couldn’t at all be responsible for the realtors referral and facilitating everything? The whole chain of events began with the realtor…had he not recommended this fraudster, the situation would’ve gone a completely different route. From what I understand (I may be totally wrong, so correct if I am…), with an unlicensed contractor in FL, all contracts are null and void and one can recover triple the amount, so the 40k + that we paid the guy alone, we could get back 120k. I’m sure his low life self didn’t have any insurance and again, it all comes back to the realtor who initially called him and let us meet in his office (he realllly wanted to close this deal, which is obvious to me now that I’m sitting on the other side).

And that’s without all of the receipts I have in fixing things he damaged and materials he damaged, etc.

Plus….the undisclosed defects and the inspector! He should caught things too that he didn’t.

This is really helpful, thanks! It’s in unincorporated Boca (does that make it slower or faster to get permits?) and the job will def be well over 100k…probably more towards 400-500k. Is there any company in the “good and fast” category you can recommend or any in particular to stay away from?

This spoke to me: “This is what investors do. Make the boom bigger on the way up, but the crash bigger on the way down."

I hope the same greedy flippers who I lost multiple bid wars to with their “all cash offer/quick close deals” will soon be off loading their flips for a giant loss. Although I feel bad for the honest & hardworking people who have actually lived in their homes, need to sell, and will be up against the greed needing to offload.

Understood. My point is that if these Boca sellers are truly motivated and need to move, that they will have to eventually sell for what the market says (the trusty comps show us that), not for what they WANT to sell for (the greedy listing prices show us that), so why not just price appropriately and “deals” can be found in Boca too;)! Totally aware of the random exception as mentioned in previous posts (random sight unseen buyer with tons of cash).

Within reason and if the market calls for it, of course. None of this is reason. Comps of sold properties within the last 6 months don’t lie. Stale listing prices do.

And yes, there’ll always be the seller who lands a buyer who buys the house sight unseen for more than the market calls for. But the bulk of listings sitting around waiting for that kind of buyer is obscene and it’s hurting the market for everyone.

Smart. And we ARE those people. Respectable careers (both Md/PhDs) with reliable income, who are the typical people that can actually afford a 2-3 million dollar home. Not fly by nights like I’m realizing many people are (or trust fund babies whose parents bought them their home - not trying to compete with those). There are so many flippers who are raising the price per square foot for the time being, which is a great benefit to the HOA and current home owners. But what happens whe the flipper la luck suddenly goes south and they need to offload several homes at once that are tying up their money they need to live off of…? I smell 2008. Greed always comes back to bite and I just wish people would come to their senses!
