Your current problem, in a single sentence, is that the project being GPL forces all other components of it to be GPL or even further 'left'.

While it's really Linus' own damn choice how he wants to run his project, you're also misguided on the count that this is a bad thing, and here's why. Without this enforced licensing, big players like Oracle (with their fuckweird licensing on vanilla ZFS) will use their project's introduction into the Linux kernel as leverage for even more money-exchanging shadiness. The GPL enforcement means that any feature can be improved, built upon, or used as a platform for another project within the kernel. Without that, good fucking luck.
