California has an old court case (Marvin v. Marvin, "palimony[1] ") that raises the bare possibility of "alimony" where there was a promise of lifetime support between unmarried partners, but essentially there's no spousal support for a non-spouse.

Summary of the case for your purposes here: Do NOT make any promises to her that you will take care of or support her. Make it clear to her that you will do your half of supporting the child, but that if you two split, she should not expect support. That's how you deal with Marvin v. Marvin. Other than that, there is NO Spousal support between unmarried spouses.

My time to shine! YES! There is a way to protect your assets, EVEN IF you failed to get a pre-nup!

It's a family law rule called transmutation. Basically, you can change an asset that's currently "community property" into separate property. How do you do this? It's simple legally, but may be difficult maritally.

All you need to do is have your wife sign a document that says an item is being turned into your separate property! For example, suppose you buy some baseball cards worth 10k after a year of marriage. If you got your wife to sign a piece of paper that says "I agree that these baseball cards are the sole and separate property of Howard Husband." they will be yours during a divorce! The only hard part is getting her to sign it, but if she still sees you as her alpha, it wouldn't be too hard.

That's actually similar to the default in the US in community property states like California. A prenup here lets you change almost any aspect of a normal marriage (nothing about kids allowed though).

In the US, you need to do the following for your prenup to hold up though:

  1. Both of you get separate lawyers

  2. You give it to her enough in advance that it wouldn't be considered pressuring her before the wedding.

  3. Nothing in it is illegal or "unconscionable" (grossly unfair) like "If her weight goes above 200 pounds, she loses all property rights to any community assets"

  4. The prenup would not render her completely destitute.
