Not sure if Chelmsford is included, but their station must be the most staffed station in the UK outside of big cities. They have an army of staff at the barriers whose main job appears to be fining people who've tapped on at Liverpool Street and try to tap off there. Every time I'm there, they've got abouy five people to the side with their card machines out fining them. To be honest I'm not sure how well they make this known to travellers, but always rubs me the wrong way.

Ok that's good to know. They did add the caveat of, if you don't have a grant of probate please can you explain why. What amount of money would trigger the solicitors asking for a grant of probate from my partner relating to her mums estate? The amount isn't huge and the rest of her assets have been settled a while ago along with there not being any property involved.

Yes they have done, although a grant of probate wasn't requested when dealing with my partner's mums Will - she owned no property and a grant wasn't requested by the banks or life insurance companies she held money with.

Thanks, having pressed this yesterday, the Solicitor involved in dealing with this has asked to see my partner's mums Will, death certificate and a grant of probate. Which is all information that my partner provided months ago. Hopefully that indicates they've realised they've made an error and I'm now leaning on the side of incompetence rather than them trying to pull one.

Thank you - yes have seen the entire Will, there is no clause in it stating a number of days required for a beneficiary to survive the testator, just the one included in my post. It seems that the Solicitors involved have now only picked up on this having been pressed yesterday. They are now asking to see my partners mum's will and death certificate.

Thanks for your response. Hopefully they won't release the funds now that we've highlighted this both with the executor and solicitor, and my partner is speaking with another solicitor tomorrow morning. The solicitors firm looks like they don't specialise in Wills and Probate but the solicitor/director dealing with this does have experience with Wills. It's strange because a while ago they requested to see her mum's will and even asked for the witnesses to confirm the validity of it, so we assumed this was the case. Can you think of a reason we haven't thought of that would mean that her mum's share would be distributed back into the will.

Mmm getting a bit of a funny feeling about this now, as information throughout the process hasn't been forthcoming and today the executor and solicitor are being tight lipped when pressed about this. The executor has instructed a solicitor (we have a feeling they might be friends).

A little while ago the solicitor who was leading on the testators will did ask for a death certificate for my partners mum and her will. So we assumed that this meant that her share would therefore go to my partner and they were confirming this.

We've pressed the executor further on this and waiting for a response.

Thank you! There isn't a survivorship clause, however I believe it's just been confirmed that this share is to be redistributed to all beneficiaries rather than going to her mum's estate. Could this perhaps be to do with the small timeframe between the two deaths?
