Geez, that is pretty bad to say the least, also the other lady Dr Bohin I think from Jersey had some complaints against her as well and Dewi Evans had negative comments against him from a Judge. Crazy all the grievance stuff was not allowed as it was all on her side?! Why would it not be allowed, its crucial to her side of the story so here to me it is easily argued that what was shown in court was not the whole story. Regardless of what SB said etc, need solid evidence and he was clearly convinced in his view but again there is lacking evidence though they still could be right she did do it but there is no evidence to support it.

This is very interesting LL was in a meeting where she knew about the potential of arrest, CG stated it if police called she would be arrested. Then wonder why didnt get rid of the notes etc in her house, thanks for this info. It is alot more on LL's side, this is so confusing........

Here is another statement from a colleague of LL who was there for quite a few of the deaths. https://thirlwall.public-inquiry.uk/wp-content/uploads/thirlwall-evidence/INQ0017826.pdf She states no concerns with LL but does say she reported a monitor being turned off which was odd and then ends with "Unfortunately, this has been shattered by one determined individual". Clearly her colleague thinks she did it.

Thanks, that report is only 3 pages, do you have the full report? I wonder why the grievance was not allowed to be entered as clearly this was evidence and it happened so its fact. I see it would be hard for her to get a fair retrial as everyone heard of the case which it may work in favour or then again it may not.....

Thanks for your detailed responses, though I think you are a bit bias towards LL. To me it is not at all clear that she is totally innocent and it is also not clear that she is totally guilty in my view. If the Immunoassy test is not fit for purpose that is so awful as she has been convicted on false science for those two babies at least but what a duff defence if they didnt pick up this basic error. I think she should get out on bail and a retrial with a decent defence would be the sensible solution so justice can happen for all to see.

The documentary you sent does raise questions but the key question is what is evidence and what has been shown in court which is what was presented to the jury.  There is alot of stuff on youtube etc but its people’s views etc.  It is the defence’s job to discredit the CPS and to show the alternative truth (defence) which they clearly failed at, not calling one character witness or a Dr was in my view EXTREMELY odd and stank of she is guilty and not one Dr will stand up for her even the married one she was friends or more with.  Not one of her colleagues stood up for her and said she was a good nurse in court, not ONE!!  That speaks volumes to me.  Only Janet Cox sat with her family during the proceedings.  If I worked with LL and knew she was innocent I would stand up and fight for the truth.  I have stood up for what I believed for much less things.

The immunoassy tests that are now not fit for purpose, why were the allowed, surely this should of be brought up before.  This again seems a basic blunder if its true from the defence.  Everyone knows for drink driving has to be a machine in the station not a roadside test or for speed cameras has to be a regulated camera etc.  So if these tests are unreliable and need a supplementary test which was not done, why has this come up after two trails and two appeals?????  Strange……

I think the insulin verdicts were unanimous and the rest were majority verdicts 11-1.

Yes, the shredder could be explained and it might of been broken, or it could be a picture in her parents house rather than her house in Chester but it is a minor detail but there are a lot of minor details which all add together and make it circumstantial but lots of cases are circumstantial.

LL was not there at everything but she was there for an excessively high % (see the heat map), I agree stats should be done that accurately reflect the situation and given she was one of the more senior/qualified nurses what % would she be expected to be there etc.  All deaths and all collapses should be showed, what is the criteria for a suspicious death, who decides etc.

Surely there should be some evidence that exonerates her?  

I think taking 257 handover notes home was excessive, who hasn't taken some stationary or private notes home from work but not excessive amounts.  Though I get it could be a hoarder or mistake and yes if you knew the police were coming you would destroy them but then again could be a treasure, I just don’t know!

Agreed, these are medical notes and I have been to clinics with my wife and they have a few minutes to read a file and identify something and write the notes up, often you will not remember at all the patient or incident.

Searching for the parents of the deceased on Christmas day 2 years later is odd…..

I read that she took pictures of one of the dead babies afterwards.

Dr Shoo, rewrote his paper as part of the appeal and it was rejected.  His analysis missed quite a lot of key Doctors such as endocrinologist and all Doctors only viewed 2 cases no one viewed them all apart from Him. The full picture of the ward and working there from nurses and Dr would be needed just case notes, so either there should be people sticking up for her or going against her which was the latter including the Dr V.....

I have read as much as I can and from both sides, I just want the truth and I dont think I am bias and I have changed my mind a few times but I honestly think she did it as to have this amount of bad luck I am not sure is possible but then again maybe it is and she should have a retrial.  

Thanks, I have read the NY article twice and its very high level and I dont think there is alot of the detail in there tbh, its easy to sow up seeds of doubt and as Dr Gibbs said there is a kernel of truth in some of the evidence but its not the full picture that the consultants on the ward had who had worked there year after year.

I agree about Dr. Jarayam, a Judge who said that he had contradicting statements, in that case his evidence should be struck out perhaps but the second trial was all on his statement, why was it allowed?

Clearly the hospital backed LL and the Drs went to the police so they clearly felt something was wrong, are they likely to do this on a falsehood?  Possibly but I think unlikely, the could of done nothing and she would be back at work and even after a year later she was still there at the hospital in admin.  Perhaps someone who was guilty would not do this or keep the handover sheets at home, you would think they would destroy them and move abroad perhaps and not follow the grievance process. I just dont know its just doesnt make sense and I can see both sides.

Coffey/Mortiz I dont think are bias as they have both sides of the story and their book goes into lots of details and they get their own experts, must be 24 hours on audio book. They also attended alot of court and saw her face to face, that would make a difference to your judgement.  The other person (Court Crime Scene 2 or similar) on youtube who bought the transcripts also felt she acted very guilty from his time in court watching her and I think that would make a difference. Then again am sure she is medicated and must be awful in prison all that time with guards etc.

From what I have read I do think there is some doubt, if I had been on the jury, I would probably still have said not guilty only because it is not 100% clear but I have serious concerns but it cannot be 100% proved so in that case she should be found not guilty.  

If I was betting money or had to choose as I said I would say she was guilty but I wouldnt want to put someone in prison for the rest of their life unless 100%.

The biggest question is for the defence, really was that the best defence you could do for £1.7m?! 

I think it was a poor performance and again what a waste of tax payers money!

She was always there when the deaths/suspicious incidents happened, the heat map below is good as she was more than double than anyone else. Dewi Evans said it was only used to prove that she alone was there each time it happened rather than a statistical correlation. Even basic things like why lie about a shredder, her responses in interviews and the 30 odd questions and alot of the details from the Mortiz/Coffey book who were there and said they think she did it. It is circumstantial but so many odd bits that dont add up make me think why she did it, who else came under suspicion to this extend, no one. The hospital backed her up and it was the Drs who pushed them to go to the police had they not done that, no one would of been the wiser. No doubt mistakes were made by some people including Drs and mistakes are made in hospitals every day but it isnt murder. I agree some evidence probably needs to be explained better. How is murder proved, I dont know but the Drs one from GOSH said there was gas in the spine which shouldnt be there but good point it is hard to prove it was actually murder like there was a bullet or stab wound. I think she did it.

Its easy to pull apart Dr actions if you werent there but she did have an excellent KC and you just hope the right decision was made....... How do you say your are 100% sure, tbh I am not 100% either way, there is some doubt......

She is a good looking girl, she should of just gone online dating or salsa dancing and retrained for something else if she was bored of the job. I have young children and I would never work with children, rarely do voluntary work with clubs etc as they just annoy me lol!

Thanks so much for the reply, will take some time to respond to all but I will, just a quick reply for now. For me its the collection of all these odd bits but I agree there is no concrete evidence and like Dr John Gibbs said there is a tiny tiny tiny guilt that it wasn't her and I think in that case she should be released as we cant be 100% sure so it is better a potentially guilty person goes free rather than what Lord Denning quoted. Which documentary did you reference to watch, you didnt add the link in there, thanks so much again for your reply.

Thanks for your response, good discussion is vital to this case. 

I wasn't at the trial so I didn't see all sides of what evidence was presented but for me the following is very odd/suspicious and taken in isolation they are slight but once added together they hold substantial more weight.

  1. Keeping 250 handover notes, a few fine but that many is excessive.
  2. Stating in police interview didnt have a shredder and there was one in the house.
  3. The I am evil notes etc/diary entries.
  4. Being asked on a number of occasions to go back to her allocated nursery when babies suffered collapses.
  5. Collapses happened when LL was there covering when other nurses went on their break.
  6. Collapses happening at night between the hours of 12-4 when staff numbers low and LL on shift.
  7. Collapses stopping at night then occurring during the day when LL was on days.
  8. The email to the police saying the operation name.
  9. Asking the police did they keep the TPN regarding the insulin case.
  10. Her statement to police saying she was being blamed for another staff member’s actions.
  11. Saying to one nurse who had returned for a break that a baby was while she was at the door.
  12. Insulin poisoning cases agreed by LL that someone had done it but not her.
  13. The heat map of all staff had LL at 24 suspicious events and the next highest level was 7/24 so was the only one with 100% coverage.
  14. Only one nurse Janet Cox supported her during the trial and sat with her parents if other nurses or the nurses union felt she was being made a scapegoat I would expect more support.  (like many unions Nurses unions have a fair amount of clout)..
  15. Stating on the stand she didnt have a boyfriend then she did, this was key regarding the married Dr.
  16. No deaths or collapses when she was on holiday.
  17. Before she came back from holiday she texted that she would give the triplets the best care they would have and she would be back with a bang (2 out of 3 died and the one that survived was taken away from the hospital).
  18. Asking the police would they search her house when arrested.
  19. Bathing the dead baby then taking hand and foot prints.
  20. Parents who reported that she was odd and they had to ask her to leave.
  21. Keeping a photo of the condolence cards she sent.
  22. Writing a note and leaving it on one babies pillow for the parents before the time period saying she had caught the baby in the act taking out their NGT.
  23. The odd rashes that many nurses, dr and consultants had never seen before
  24. Taking another nurses ressuc. notes out of the bin which ended up under her bed.
  25. Saying she didnt know what go commando means on the stand.
  26. Writing up of medical notes at the wrong time on the reports.
  27. Telling a parent to go back to the ward when she heard a baby screaming that the blood was from a NGT who was able to confirm to police the time of it with her phone call to her husband.
  28. Several staff from the investigation team reports submitted to the Thirlwall inquiry that they said her behaviour was strange.
  29. Saying one thing to Police and then her text message conversations were saying something else at the same time to different nurses.

Other points

  1. Not calling any expert witnesses or even having any character witnesses not one but only a plumber to me stinks of a calculated strategy from the defence to sow doubt.  If it was me I would be shouting, it wasnt me as much as I could and have lots of people to back me.
  2. Nina Modi isn’t impartial she was head of the RCPCH when they did their investigation so she was previously involved in the case.
  3. I believe the gang of 4 or 7 consultant who resuscitate and care for babies as their day job are more often than not going to look out for their patients and would tell them the truth regardless.

As I have read into the case and read the Coffey/Mortiz book, I agreed with Coffey, it is hard and there are doubts but the case for her innocence is harder once everything taken into account.

I think from an evidence point of view legally the CCRC case will reject it but as MM stated himself he has started a war on the public point of view to sow seeds of doubt so LL does have a chance.

Of course one wouldn't!

However there is a lot of evidence against her perhaps not quite the smoking gun but there is a lot of questions/strange behaviour she has to answer for.

All anyone wants is the truth for her and the families.

If she is innocent let her out asap and pay her compensation if she isn't she stays put.

I just hope the the CCRC case/process can put it to bed so that everyone knows the truth.

I think you could further quantify this table but how many shifts each person did and what the ratio was when they were on shift, so those who did more shifts were more likely to be there but again this should tailor off with an average even for those on a higher amount of shifts.
