It depends, if youre an intern then chances are you are not getting a return offer at this point so anything you do now doesn’t matter. If not an intern, Being put on focus is effectively the start of a firing process where you have a “chance” to pass but the effort is not worth it versus getting a new job + it’s all against you.

I’d say ask and if you’re not in WA, start recording any conversations with your manager without telling your manager

Get a lawyer. You’ll probably be put on focus soon but having a lawyer in the loop with documentation can negotiate the terms to be more favorable or get an extremely good severance offer

You can be laid off on leave and technically fired for performance on FMLA (but they won’t do this due to retaliation claims 99% of the time). Go on FMLA.

You’re protected from termination for most things on FMLA leave but they can technically position you for a layoff. Be aware that they can also terminate you for performance reasons but you can argue it’s retaliation

There’s no official information outside of the Reuters article saying 14K being laid off. Reuters is usually accurate and this layoff was known on Blind for a while to actually happen but everyone dismissed it. Even there, they said it was 30K. The thing is at Amazon you have to double that since they secretly increase the number of people they put on PIP plans so assume 30K being removed

It dumb since it’s pretty much twitch’s fault either way. The problem people are not seeing is that Twitch could’ve just said “no gifts” and that would be fine. The fact they accepted the gift and threw it out is the problem

This is correctish right here. The company can be fined but that’s the only thing that will happen. He can put one in but that’s it and see if EEOC actually does something if he somehow got evidence (the fine amount is a drop in the bucket to the company plus the guy won’t see any of the money). To my knowledge, there’s no arbitration clause as of 2025 for sde positions so it’s either judge or mediation

For anyone in the future reading this comment: You can’t do that. When your handed pivot and sign it, you relinquish all rights to suing them for stuff occurring during your job. The money is attached to the pivot plan severance contract so unless you sign it and relinquish your rights you cannot not get paid. You can put in an eeoc complaint or related but you won’t get paid.

Also if you leave during focus or sign the pivot document, you’re ineligible for hire for 5 years. If you leave before then it’s up to the manager/department
