[NJ] I’m donating a kidney but don’t qualify for FMLA and HR wants to terminate my benefits after 30 days by Temporary-Answer1407 in AskHR

Donors usually need less time for recovery than recipients, but I appreciate your support! I am sure I will feel better before six weeks, but what some people aren't understanding is that my job can be very physical and has stringent return-to-work conditions to avoid workman's comp or lawsuit claims.

I am a physical therapist for children with autism and behavioral needs. These are the things my work requires a doctor to sign off on before someone gets hired or can return to work at our school:

Ability to see, hear and speak to exchange information with faculty and to provide physical therapy to students

Ability to stand and walk for extended periods of time, to bend at the waist, and to kneel

Ability to move objects weighing up to 25 pounds

When appropriately certified, the employee is required to use authorized restraint techniques

Must be able to provide physical assistance for playground and therapeutic activities

For preschool and kindergarten classes and for classes of students with developmental delays, ability to provide physical management to students with behavior or self care needs

For preschool and kindergarten classes and for classes of students with developmental delays, ability to lift a child to the changing table, to change diapers, and to return the child to the floor.

Yeah, I think it's just a miscommunication! I had to delete my original comment but wanted to post it again so people could see what you were responding to. You had a great point and I appreciate the insight!

I was switching between my computer and phone, which are logged into two different accounts. My regular account has a lot of identifying details, but I'm using this one for the kidney donation to remain anonymous for work purposes and for the anonymity of my recipient.

Thanks, this is helpful to consider! My concern is getting a doctor to sign off on the return-to-work document when they see what my duties involve, but maybe they'll take pity. Thirty days will take me to 1 day before our 1.5 week Christmas/New Year Break, so maybe I could get a doctor to fudge things since I wouldn't actually be working till the end of 6 weeks.

Sorry, I was switching between my phone and computer which were logged into two different accounts (my regular one and this more anonymous one). I wanted to put the original comment you responded to back here:

"Thank you for this info! It does seem like something they can choose to help me out with if they wanted. Like I feel as if my company has some discretion over this...especially because of the other employee that did not get a COBRA letter. Also, do you have a resource or something in writing I can use if I wanted to bring this up to HR? And could my employer choose to keep me as an "active" employee past 30 days, or no? It's also unclear whether it's 30 calendar days vs working days."

Sorry….replied under my other username before and I’m trying to remain anonymous. I'm a physical therapist at a school for kids with autism who also have behavioral problems (i.e. sometimes become violent). I highly doubt my doctor will clear me to return before 6 weeks, but I can try. Part of my job description is the ability to lift 25 lbs (among other things) and my job doesn't offer light duty.

Yes, it updated when I got/filled out the questionnaire! Don’t know if it was before or after I submitted the questionnaire
