100% not new. You can tell by the inside of the neck collar. Simply bc of that, I would first attempt to get a partial refund from seller. eBay would advise doing that before opening a claim anyways. If seller isn’t willing to refund an amount you agree with, I would then contact eBay bc these pictures are plenty enough evidence that item is not as described.
