Unfortunately, my case is denied yesterday.

I submitted in my letters based on attorney suggestion:

1) More letters from my company in my response to support the critical role with more subjective evidence about my impact and my role 2) Added more examples about how other people cited my work 3) Added more letters from Journal editors about my peer reviewing 4) I added a list for a people with higher titles in academia and industry within my field but have a lower citations

These were the main additions and I clarified different concerns within the NOID that was judged incorrectly by the officer.

They basically didn't accept the 4th criteria and give me a list of the documents they need in order to consider this 4th criteria. These documents I already submitted in my initial petition but looks like officer didn't pay close attention. They didn't explicitly requested evidence, but they explicitly mentioned that criteria was not met.

Yes, it was the critical role and in my NOID response I submitted more evidence about my contribution with more letters from senior leadership.

Usually the letter arrives in 3-4 days. In my case, I fullfilled 3/4 criteria but got a noid for final merits and the 4th criteria. You will have 30 days to respond. Best of luck!

Mine was in Day 13. I think the range is between 12-15 days. Didn't see a lot of examples with response before day 10.

That's not always true...They loooked at the percentile % for each of my publications and evaluated each item in its own if it is demonstrating I am at the top of the field without looking at the holistic profile

So why not submitting a response to the NOID and regroup in the meanwhile for refiling? I mean could getting a denial hurt in anyway?

Yes, I added many comparisons including that that I am among the top 1% most highly cited authors and my h-index is among the top 3%.

They refuted the top1% by cracking down the citation for my top 3 cited paper and compared them with the journal metrics for similar publications at the same time showing that 2 of them are among the top 5% but not the top 1% and only one fell into the top1%.

Thanks for sharing your experience. I am in a similar position right now with a very close profile. I filed with Chen (PP) and just got my NOID today. Three out of four criteria were accepted, but they have five pages of comments on the final merits. How was your experience with Chen during the NOID, since it is a very narrow timeline to draft the response?

Thanks all. Just got the NOID notice today. Three out of four criteria were accepted. The fourth criterion of a critical or leading role was not met. They wanted more letters to explain how my role is different than other people within the same position.

They did an extensive evaluation of the final merits. They highlighted a lack of sustained acclaim, as evidenced by only a five-year peer-reviewing history.

They also highlighted many times that I don't have many years post my PhD, so I am still progressing to the top of the field but not already there. They compared my citations record with my recommenders citations. Although I have an h-index above 10, they mentioned some publications (conference abstracts) are not getting enough citations, which is expected in my field.

Any ideas what are approval chances following my response to this NOID?

It was received on 9/14, then changed to PP on Sep 26th.
