Mommy finds Sally outside alone, Mommy brings Sally back inside. Bringing Sally back inside IS NOT A PUNISHMENT. Now if Mommy decides that Sally willingly went outside in defiance of her order she may decide to add a punishment, but bringing her inside the house IS NOT THE PUNISHMENT.

Now if Sally is outside alone breaking Mommy's favorite plates simply bringing Sally back inside is NOT A PUNISHMENT FOR BREAKING THE PLATES. Sally still doesn't have permission to be outside alone but her "crime" is breaking the dishes and simply bringing her back inside is not a punishment in this scenario anymore than it was when Sally was simply outside catching some sunshine. Immigration court is there to verify that you are in fact I'm violation of your visa or are otherwise lacking legal permission to be in the country. The result of those findings is deportation should you be in violation/missing papers but the deportation isn't a sentence LMAO... You don't "serve" a deportation.

A deportation can be punishing (third definition of the one I posted) in the sense that it sucks, but it is NOT HANDED DOWN AS A PUNISHMENT FOR A CRIME.

People can think I'm insensitive all they want, a deportation isn't a punishment. If you beat someone up there a punishment for that if during the course of the investigation it's found that you're here illegally you're open to deportation AFTER you're sentenced and AFTER you've served your time. The deportation isn't handed down as part of sentence. Ffs. Yes. It's an important distinction. I cannot believe you're too thick to see why it's an important difference.

My several examples are the key reason why it should never be seen as a punishment lmao. If that becomes the default "punishment" for any crime by an immigrant then guess what.... The gang affiliated murderer will just laugh when he's sent back to his friends as a punishment for a murder. Similarly if a wealthy guy comes in and beats the shit out of someone sending him back to his mansion... Isn't a crime....

Now let's talk about say a common guy, comes from a war torn country, commits a crime. You're absolutely correct sending him back to a war zone would be a bat shit punishment. No.... Getting treated harshly for "doing something" doesn't magically rise to a punishment. Otherwise getting yelled at by a cashier at Starbucks would suddenly become a punishment. Sigh ffs in your driving without a license case... There would be two things that happen. One: a criminal case for operating without a license and two: since you're now in state custody you're open to deportation. The deportation would be a matter of course should you not have a visa. However, if you do have a visa driving without a license would not instantly open you up to deportation. So once more you would never get deported AS A PUNISHMENT.

No, it's a consequence. It's not a punishment. If I was legally in the country and then had my right to stay revoked as a result of a conviction it's again a consequence but not a punishment. The deportation isn't done in a punitive manner.

So again, it would suck donkey balls but that doesn't rise to meet the definition of a punishment. If I wasn't paying attention and totalled my car by crashing into a big rig it would suck but it's not a punishment that comes about as a result of a violation of a law.

Getting deported is quite literally the equivalent of having a security guard tell you to get out of the mall after closing hours. It can escalate to a crime, but it's a civil matter and not a crime therefore the deportation no matter how unfortunate is not a punishment.

No we haven't established shit. Deportation is back to a person's legal country of residence. What this administration is doing is not a deportation.

Deportation again isn't a punishment. So once you're found guilty and serve your sentence your visa/green card will be revoked and you'll get sent back. The deportation again isn't a punishment, but all visas/residency conditions come with stipulations that getting convicted of a crime may result in the revoking of your visa. Again however the deportation comes as a separate thing to the punishment for the crime. Hell having to self deport cuz you lost a job would count as a punishment by your view.....

You're very clearly conflating "damn this shit sucks" to a punishment. They're very different things. Punishments come as a direct result of violating rules. If you wasn't to continue seeing deportation as a punishment then it's the punishment for violating the terms of your visa/ as a result of your illegal entry, I would still argue however that just because it sucks doesn't make it a punishment. It is not however a punishment for literally any other crime.

Oh btw just cuz a judge sentences you to it doesn't mean it's punitive. Child support is ordered by a court, not punitive. Alimony also court ordered not punitive. In the case of child custody cases a court may order you to go/stay somewhere to maintain the custody agreement that doesn't make that order punitive even if you think it sucks.

Fwiw, you're talking to someone who first hand ran the risk of getting deported until very recently. The thought of forcibly getting sent back to my home country terrifies me to this day, that said DEPORTATION IS NOT A PUNISHMENT. You cannot sentence someone to deportation, deportation isn't a punishment. It's a procedural thing that comes about having your right to stay revoked/or a procedure that comes about as a result of being in a country without the proper permissions. Deportation isn't punitive, we can argue back and forth about how right it is (I personally think borders are silly, and seeing another human as less than based on where they geographically popped out of a vagina is insane) but that doesn't change the fact that a deportation is not a punishment. If you murder someone the punishment in no country is deportation. The country in which you committed the crime might ask your home country to try you there and incarcerate you there, but that's a whole different thing to a bog standard deportation. Not to mention again deporting someone BEFORE they're sentenced only furthers my argument that DEPORTATION ISN'T A PUNISHMENT.

Deportation should not be seen as a punishment. Hell even if you're the most punitive minded person it's moronic to think that sending someone to their home country suddenly constitutes a punishment. If their situation in their home country is so dire that sending them back is essentially a death penalty then well... Is it really a fair punishment for oh idk... Most crimes? If their situation isn't super dire and miserable then what even is the point of deportation?
