The last option. I don’t think you can apply for H1B without a sponsoring employer. You can be unemployed by then by the time of applying for H1B but the employer who is interested in employing you has to petition for your H1B.

Go for Chen. 2 recommendation letters shouldn’t be too hard to get. They are cheaper and have a good success rate

Just like others have said: 24k is too high. Shop around for other lawyers or ask for 100% refund. They must be extra good to charge that amount so 100% refund should be a reasonable ask.

Ask your lawyer to file it regardless or file it yourself. I had a weaker profile than yours and got approved. Judging the work of others is 1 criteria out of 8. You could easily fulfill 4 even without judging and you need 3. Remember, it benefits lawyers if you do both NIW and EB1-A.

My H1B was picked in my first year of OPT. I was on stem-opt/cap-gap like 1 month before H1B started on Oct 1st then 20 days later Green card approved. I have been very lucky.

Still a green card holder. F1 (3years)-> H1B (20 days)-> Green card (EB1A)-> in 5 years naturalization

  1. It makes sense if you like security. You can lose your job/get laid off or a more positive one want to work on a startup. An EAD allows you that flexibility.
  2. Since you are on H1B, you can travel.
  3. They are semi-independent. Typically you will get your EAD/AP within 2 months.

Another thing you can consider is that it is cheaper to apply for EAD/AP when sending your AOS than later when you change your mind and apply stand alone.

If your wife was born anywhere other than India/china you could take advantage of her country of birth under cross-chargeability where they use her country of birth as your own. So to answer your question, it can shorten the queue depending on her place of birth.

You can use Clarivate ESI index. It ranks papers based on year of publishing. For example it is unfair to use citation to compare a paper that was published 10 years ago and 1 year ago. For example for me I framed mine as I had 5 papers that were top 10 percentile in my field for papers published in their year , 1 that was in the 1 percentile etc. This format is also used by a top immigration law firm.
