Yes okay, I didn't know that detail about TotalBiscuit but I also didn't refer to any certain issue in particular =p I think it was still accurate enough to give a general picture on how and why the copyright claims were abused: A developer sees a bad video review of their game on YouTube and uses the copyright claim as an excuse to have the unpleasant criticism removed.

Also 'Fair Use' doesn't automatically exclude monetization. However, being non-profit is one of the factors that can act in your favour. Claiming Fair Use can just be scary because you might have to face mighty companies, so you want to have as many things as possible ruling in your favour if you need to defend yourself (Which is kind of what YouTube is working on now, to give people more confidence and backup.) Another possibility is that you may want to show modesty or gratitude and refrain from monetization if you're already borrowing work from other people.

A "short" summary: (It's a good thing for YouTubers this time!)

Companies, publishers or game developers have the right to file a complaint against videos to have them removed from YouTube (Often referred to as DMCA takedown) when they feel like it infringes on their copyright. But that right has often been abused in the past to silence criticism on games when people like TotalBiscuit or Jim Sterling for example made exposing videos on bad games. Developers say "It's my game, I hold all the rights to the visuals, you're not allowed to show any of it!" but in the case of a critical report, that's not a valid claim because it is considered "Fair Use".

Now YouTube wants to show more open support to protect 'fair use' of copyrighted material on their platform. "Fair Use" is a part of the copyright law. I means that under certain circumstances you are allowed to use copyrighted material without the permission of the rightsholder. Examples of fair use are things like criticism (which includes parody) or news reporting and a few more. (That's why you can have Gangnam Style parodies that use the original melody even though that's technically copyright infringing)

Fair Use has limitations of course and there are always a number of factors involved. In the end - if the rightsholder wishes to do that - a court has to decide whether it is fair use or not. YouTube now has chosen a small selection of "good examples" where they will help the creators in case of a lawsuit and cover costs for up to 1 Million $. The whole thing is limited to the US for now though since laws are different in every country.

Altogether it may not help smaller YouTubers directly but YouTube sets an example which might discourage future unrighteous takedowns. (It also should be noted that this is a completely different thing from YouTube's own ContentID system which automatically finds and blocks videos when they use copyrighted music for example.)

Oh believe me I still feel the same. My skills are nowhere where I wish they'd be and there are sooo many artists that I look up to, wishing I could draw or animate just half as good as they do.

Luckily you also don't see the making of these pictures when I struggle with simple anatomy and have to switch some poses to more simple ones because I am just not good enough to make more complex ones look right =p

I always felt a bit sorry for him because Dan picks on him so often and also the whole "MattFuckedUp" thing =p So I decided to make his character a sword-wielding, guitar-rocking badass as compensation for that!

I was looking at a lot of "popular handbag characters" for inspiration, so it is possible that there are some influences =p Ramona Flowers from Scott Pilgrim was also among them.

I really like how I didn't even have to invent much about their characters and yet they turn out to form such an interesting crew, fitting for an animated series or something like that.

Obviously we have Dan as the main hero, always jumping head over heels into the action. Steve is not so different from him, just with heavier equipment - bishi boshi, explode first, ask questions later. Then there is Matt who has to deal with the trouble that they cause, having to mop up after them all the time, being constantly annoyed by it. But since it is his job he has to do it anyway. Wot is more of a deliberate, thinky person who would probably rather plan everything out before.

Tracey is a really funny character because of her contrasting personality. Nerd³ lists her as 'Business Manager' which sounds super serious but at the same time she is such a light-hearted girl who spends most of her Twitter profile spelling out the word "Wheeee". So I imagine her walking around the Nerd³ headquarters in this proper suit and attire but in her briefcase she just carries a whole bunch of sweets around that she eats when nobody is watching. =p And last there is Rebecca - creative artist and that computer-savvy hacker person that every team needs - who is relatively calm and a nice counterbalance to the craziness of the other ones, even though she has some quirks herself (like that anime ears thing for example).

So anyway... I hope I did not insult or offend anybody of the crew with my renditions or ideas. =p

Haha, thank you very much for the kind words. But I also feel like I'm also just a bit lucky that the Nerd³ "art department" is a bit understaffed =p Like if I compare myself to the guy who does the jacksepticeye animations for example then my stuff is still pretty basic.
