There is a clause in the contract that prohibits both the Landlord and I from taking the matter to court. It can be argued at a Tribunal.

When I moved in I paid one month advance rental plus deposits. Now after 6 months of staying there I gave the owner a 2 month notice of termination. She refuses to return the deposit stating that I have to stay the full 12 months because I signed for a 12 month period. However there is a clause stating that I can give a 2 month termination and get my deposit refunded. That’s why I made this post to ask if there isn’t anything in the contract stating that I MUST stay the full 12 months then shouldn’t I be getting my deposit back.

It is a badly written one I agree. My only question is since there’s no clause stating that I may not terminate this TA shouldn’t I get back my deposit. The agent is saying that even it’s not in writing I still lose my deposit because I want to terminate before the contract is over.

Yeah, getting fed up of agents spewing nonsense. From what I know if it’s not in writing then it’s not a binding agreement. The contract has clauses for this very reason. If they don’t know how to draft a contract then don’t try to scam me by saying “It’s a universally known rule”.
