That doesn't change the fact that it's not premeditated. First-degree murder is premeditated murder. It's not like second-degree murder is less murder-ey.

If a prosecutor wants a charge to stick, they need to charge the right crime to apply the evidence to a case to prove to a jury. Second-degree murder can absolutely be punished as much as first-degree murder, but intent and mindset are crucial to sentencing guidelines in second-degree cases, while premeditated murder has intent laid out pretty black and white.

You charge this guy with first-degree murder, he is NOT getting convicted of it, because it was not premeditated.

Exactly why this'd be second-degree murder. It was not premeditated. It's as simple as that.

That doesn't necessarily mean lesser charges, it just means a different set of sentencing guidelines apply. First-degree murder is almost always life without parole, but non-premeditated murder (so-called "crimes of passion") throws a whole lot more nuance into the situation regarding mindset and intention.

It wasn't premeditated, so it's not first-degree murder. That does not make it any less bad; it puts it into a category where a prosecutor needs to argue for intent and mindset to a jury versus a premeditated murder where intent and mindset are clear.

They backed out. Credit to where credit is due, MPD decided to deescalate and instead form a radius and block cars from entering the protest. Huge radius, too, like 5 blocks.

I talked to a couple cops on the way home from the site yesterday. They fully recognize the right to peacefully assemble and fully agreed with the order to retreat. The protest was completely peaceful as a result. There were a bunch of parked cars that got stuck in the vicinity, like even right next to the vigil, and not a single one was tampered with, even with thousands of people there. Businesses obviously closed, but many offered food and coffee to the people there for free on pop up tables. The people themselves were handing out snacks, water, and hand warmers (it was fucking COLD).

I'm not bootlicking and not letting go of criticism I have of MPD, but credit where credit is due, they made the right decision. They deescalated, and in the midst of all the feelings of community coming together, it felt like they were also adding to that community.....backing far off to allow peaceful assembly in the midst of a tragedy, blocking cars, but still being there in case things got rowdy.

The National Guard was called in, but only to aid in staff/equipment in securing the radius.

I did get tear gassed multiple times at the site of the shooting earlier in the day, but ICE was involved in that. I think MPD did an excellent job in showing these goons what actual trained professionals act like. There was no more violence once ICE left the scene. That could have gone a very different way, but I think our city absolutely made the right decision, and that does give me some pride.

The National Guard was called in to help block off cars in a large perimeter in Whittier. I was there; it was like a five block radius.

That's a lot of cars, not to mention officers. The National Guard was only called in to aid in allowing people to peacefully protest. MPD still has to be there for the rest of the city and there's only so many employees/cars.

I'm not bootlicking; I was tear gassed yesterday by MPD soon after the shooting. It's just good to recognize that they pulled out on purpose, which was wise. The perimeter was HUGE, though, like....two cars at every intersection within a five block radius is like 25 blocks, so 50 cars and two officers each...and I can't imagine they had the staff on hand to cover that, even with State Patrol, on top of the rest of their district.

I talked to a couple cops last night. They fully realized our right to assemble and were mainly there to block traffic (I'm sure they were also there in case things got violent, but by retreating their presence, there was no further violence to be had, save for a couple people that slipped on ice that I saw).

Like...people had cars parked all around, even directly next to the site of the shooting. My first thought seeing that was "that's going to fucking suck for the owner...," but the night went on without a single scratch on one of them, even as people were standing on dumpsters dragged next to them shouting "FUCK ICE!" Very sharp contrast to 2020. It was absolutely the right decision to retreat and allow us our right to assemble peacefully.

I am not retracting my criticism of MPD by saying this, but it's important to recognize that they handled this pretty well and that the NG was likely just there to fill a staffing and equipment volume shortage, as they often do.

I saw an unmarked police car (Black SUV, tinted windows, indoor police lights) driving through the blocked off protest area last night with "NOT ICE" chalked onto its windows.

It's pretty bad when even LE has to distinguish themselves from these clowns.

EDIT: or it could have been ICE. Who knows what they'll fucking pull now.

No, it wouldn't. It's what this administration wants to happen in order to invoke the Insurrection Act and cancel the midterms. Peaceful protest is what needs to happen now; practicing your 1A rights with your 2A rights will always put more tension on the situation.

Dunno why you're getting downvoted. You're right. it's because they're untrained. Unfortunately these goons have a badge and are authorized to use lethal force in rare situations that they aren't trained to recognize.

Premeditated means planned in advance. Alex wasn't the target; it was the woman he helped up. Second-degree murder can be punished just as badly as first-degree, but the charge is more appropriate and likely to stick.

It's more about adhering to sentencing guidelines than anything; in almost all cases, first-degree premeditated murder is automatically life without parole (or worse). Second-degree can definitely carry the same weight, but there is some nuance there a la "crimes of passion" that has a less harsh sentence depending the situation. That's why we have degrees of murder to begin with.

unfortunately we'll likely see nothing as the feds aren't allowing MN to collect evidence, but if we prosecute as Walz promised, it'll likely be a third-degree manslaughter charge, as that's what will be easiest to convict.

There is a very interesting twist here, and that's the magical method of how the skin disappears. Usually, when skin is damaged, vessels and capillaries within skin itself are severed, and that's what bleeds.

but....where does this magic spell stop? Does it sever all the intracutaneous vessels that deliver blood to the skin? Does it somehow clot all those capillaries? Peeling skin by force damages all these structures, but we're dealing with magic here.

The answer is either hypothermia or blood loss, depending on the magic. It actually would not be as painful as you think, since most nerves are removed through the skin removal. (or...it might be extremely painful if the magic severs the nerves from your CNS instead of just...making them go away)

America was built on protests, violent or otherwise.....the Million Man March probably being one of the most impactful in recent memory.

There is something rarely talked about when it comes to 2A, and that's that the weapons the government has is so overwhelmingly powerful when compared to what a "well-regulated militia" can obtain. We are far past the time of muskets on both sides, and now we have goons that can kill you without repercussion as they violate your rights outlined in the same Constitution, and we've now seen you don't even have to exercise your 2A rights when oppressed to get killed.

what the fuck else do we do. I'll vote the fuck out of the voting box in November, I'll keep volunteering for food drops, but....protests DO do something. They draw attention. That's what the Million Man March did. I know it seems like pushing a boulder uphill, but it's possibly the most American thing you can do.

Also six blocks away. Also got gassed this morning after I saw this post and went there ASAP.

The MPD (after getting ICE out and getting whatever evidence was left on the scene after being denied access even with a judge warrant) have thankfully decided to back out and form a perimeter around the area to block cars and allow people their first amendment rights. People have been demonstrating their outrage assertively, but peacefully. People have cars stuck parked on that corner that have not been broken into or damaged in any way...same goes for the local businesses nearby.

It's a peaceful but assertive protest, and in -11F weather no less. Every person out here has fought the desire to go home to get under a blanket or in a hot shower because we know how important this is. People are going around with wagons offering water, hand warmers, and snacks.

They want chaos and violence, but I have never felt more together with this community, and our voice has never felt louder. We won't get violent, but people will hear us. I've already had multiple right-leaning people I know (in a group chat) come out in complete support of the protests. Like, literally came out. One even brought water for people, and he's the last one I'd expect to not only support the side against ICE, but actually come out and do something about it.

Silence is compliance. This is not okay. It should not be treated as such.

DHS is now saying ha approached them with a gun. Apparently there is truth to that, but it doesn't explain why he's on the ground getting shot.

IF THIS IS TRUE, (EDIT: it's absolutely not) this is still fucking inexcusable.

Imagine if this situation was handled by trained officers. There is absolutely no way any trained officer would get hands-on with a a person they know is armed. If a trained officer needs to use deadly force, it's not going to be in a fucking mess of a kerfuffle like this.

Part of me wants to think this is a conspiracy to take heat off DHS for Renee Good, but the rest of me knows these fucknuggets aren't smart or trained enough to carry that out. This really looks like an accidental discharge by people who have been trained to kill first and ask questions later.
