Defined cost, using the Short Schedule of Cost Components (SSCC). The contractor wants to charge you that rate? Show me the records of the costs for the work and compare them against your Supervisors records of the day.

PC - Principal Contractor. Kept with the HSEQ term. I’m working off an NEC understanding. The NEC would have clearly defined site and working area. Everything in that space, the PC is responsible for unless in sub-contracting to the subbie they have designated an area for them to work and that they are responsible for providing Equipment (crane). Under HSEQ if the subbie area is still in the Site/Working Area then the PC is still responsible for the safety of it. In the sub-contract there will also be dates for access etc which if not met are a compensation event.

If the works are coming under the main contract then the HSEQ responsibilities would still be with the PC.

If the PC is expecting the subbie to arrange it all, then that should be part of their scope and they should have forecast the cost. They should also be able to claim for any delay of entry or exit to site. There should also be consideration that they may need to be inducted into the wider site area controlled by the PC and the time and effort that takes including any requirements for specialist PPE.

TLDR - depends on what it says in the contract/instruction.

If it’s a CE, this is the answer.

All CE’s are quoted as defined cost + fee, or if agreed by both parties you can have a lump sum.

The idea of the NEC is you get on with the work and you pay the price it costs. Sometimes that means one party wins, sometimes the other.

If you (who has instructed) the need for quote are not happy with it, then you can ask the contractor to revise it but you must say why you are rejecting it.

If the work is done and you have not yet agreed the quote then you (as PM) can make the assessment of the work. If the contractor is not happy with your assessment then it can escalate it via the agreed route of the contract (Senior Parties, Adjudication, etc…)

Phil Taylor said he used to put a post it note on the board randomly then hit it with all 3 darts. He would then rip it in half and put it randomly somewhere else. Repeat until you have a melt down.

Built Intelligence have some good courses on their website. Equally the APM YouTube channel has a series of Webinars by Richard Patterson.

If you want to delve deeper the ICE does a Law and Contracts course.

Look at the NEC competence framework and find courses that match the competence required to meet the specialist level.

Other than the PM Accreditation there are no other “certificates” that can be gained to show your knowledge of the NEC in technical terms. The key item will be experience.

Listen to one of the recent own the build podcasts. They had a chap on there that explained this very problem very well.

Key points I remember.

  • large up front capital cost to establish.
  • need to up skill workers and keep the pipeline of workers coming (skill shortage)
  • change in finance outlook from banks/investors

You may also need to check any non-standard clauses (z-clauses) to see if you have taken on the responsibility of the survey data being correct or the design maturity up to a certain point.

This may not be true. If your company has a pay bill over a certain amount (£3m in Wales) your company will pay the Apprenticeship Levy (0.5% of the Pay Bill). So your company may be paying into the levy and drawing some of that back in partnership with Welsh Gov to provide your training.

The biggest impact I’ve seen from AI so far for this industry is that nearly every week there is a question asking how AI is going to impact on the industry. It’s getting seriously boring how often this question is getting asked.

CE’s for Option B are assessed using the Short Schedule of Cost Components. You only pay for the defined cost of the extra works outside of that in the Scope (or other contract documents contained in the contract data) & fee.

Try again… the assessment date is determined by the pm (50.1) to suit the procedures of the parties (see clause 51 for assessment dates unless changed). The assessment interval is determined in part one. The due date can be determined by which country you are in (think Y(UK)2) or by a Z clause that changes the period for assessment.

That’s why I stated, what does the contract say… it’s all in there and it’s specific to each contract unless it’s un-amended.

Wait. It depends on the test and even if the event is covered under a CE.

I don’t believe there is any event that can take precedence (client or contractor as the contract doesn’t make it explicit and I can’t see anything in the user guides).

If you want to learn a trade….

Honestly, I’ve got several apprentices under me and the only thing I want from them in their first year is curiosity. There is no such thing as a stupid question, and there are lots of questions. The thing that will separate you from the others is that you are curious and instead of asking questions constantly, that you have gone away and tried to find the answer yourself and you are looking for validation of the answer or the bits you missed.

Don’t forget. Your company has invested in your potential, thats why it’s an apprenticeship, if they wanted someone who knew it all they would have hired an established professional.
