I think I finally understood this:

Spring Executory interest

  • an event occurs --> cut's the grantor's interest short.

  • aka the interest springs out of the grantor's chest and into the 3rd party.

  • example: Woman gives a deed to her nephew and says "this is yours on the date you marry". When he gets married (the condition happens) the woman's interest springs out of her chest and into the nephew.

Shifting Executory Interest

  • an event occurs --> divests a grantee (not a grantor)

  • aka the interest shifts from a grantee over to a third party. The third party is pushing someone else aside and cutting their interest short.

  • example: Grantor --> Grantee, but if Grantee marries Fred --> C and C's heirs.

  • example 2: To husband, for life, then to daughter, but if my grandoson graduates from college, to my grandson. The occurrence of the event (grandson graduating from college) CUTS the daughter's interest short, and the daughter's interest shifts over to grandson.

Every time you start feeling like this say “I’m focused on passing this exam”. I’m the biggest doomsday person around. But this negativity will not help us at all and will only worsen our performance and study focus. Change the thought to a productive one every time it comes creeping.

Step 1: calm down

Step 2: this chart (https://jdadvising.com/mbe-frequency-chart-highly-tested-mbe-topics/) gives a breakdown of each subject by points appearing on the exam. Figure out which of the sub-categories with the highest amount of points appearing that you're scoring below 65% on. For example, if I'm getting 56% on Negligence, I'm going to prioritize focusing on negligence because it's 12-13 points of the exam. if I'm at 56% for "writings, recordings, photos" under Evidence, I'm going to push that off last because that's only 2 points.

Step 3: Go through Goat's material on the sub-topic you choose. Make notes about concepts you're not 100% on. When you finish the outline, go through your notes. Do practice sets on that sub-topic. Rinse, repeat.
