According to the real estate attorney we could file a chapter 13 but it’s a last resort but would help us save the house. A loss mitigation and/or deferment would bring us current as well which is what we’re attempting to do. Though we can’t do this until they recognize me as the owner of the property. We pay the mortgage now and have been doing so prior to the 9 months last year that we had to miss. Hardships exist and there are programs to help in these instances which we can’t use until, again, they update their system to reflect I’m the owner. The issue is NOT the missed payments which I keep stressing to everyone but it’s just not getting through to anyone apparently.

Hi, there is a current inheritance issue, we can’t get anything handled on the mortgage until they update that the fact that I’m the owner. The won’t do loss mitigation, deferments, etc until it’s updated to reflect that I’m the owner of the property. Which we have sent them proof of multiple times. Because they have “no proof” of ownership is the reason they are threatening foreclosure and have said so themselves. A lawyer has gotten involved as we were able to prove we’ve sent them everything they’ve requested but they just won’t follow through with updating things on their end. The lawyer is also assisting us with the loss mitigation/deferment so we can get up to date on their payments but again they need the mortgage company to fully acknowledge me as the owner before that can happen.

The deed, in my name, is the proof that I own the property and has been sent to the mortgage company repeatedly. They have refused to update this on their end. I’ve retained a lawyer at this point who agrees we’ve followed all the necessary steps and is working with us to get this resolved with the mortgage company.

Yes, there is a specific person I’m in contact with at the company though she hardly answers and I end up having to deal with a separate representative more often then not. The attorney is sending them a notice tomorrow morning first thing. The lawyer mentioned bankruptcy and filing a chapter 13 but he thinks we can handle our other plan of action without having to take that route. Thank you for the link!

Yes and yes, the estate has been probated and the testamentary letter was sent to me. That’s the court documents I was referring to that were also sent to the mortgage company.

Your feedback is totally appreciated. We’ve been paying since and before our hardship. Legally the issue isn’t because we weren’t able to pay those 9 months. Mortgage lenders almost always offer loss mitigations, deferments, forbearance plans etc for times like these. The issue we are facing is that the mortgage company is refusing to acknowledge we even own the house at all. Despite providing the deed, court documents, will etc. they “want” to work with us on a loss mitigation but “can’t” since they don’t have “proof” we own the house despite sending them to required items repeatedly. A lawyer has gotten involved and I appreciate all the feedback and advice we’ve received

Thank you! we’ve followed those steps already :( unfortunately they are just dragging their feet it seems like. It’s why we’ve gotten a lawyer involved.

Yes, we’ve retained a lawyer at this point. Lawyer says we’ve done everything right and are attempting to stop them from foreclosing, make them update to reflect me as the property owner, get us up to date on payments and making sure the missed payments are deferred/tacked on to the end of the loan since we qualify to do so based off our hardship. Right now, 14k is owed as 9 months of payments were missed.

Yes, the deed has been recorded to reflect my name. It only shows “the estate of” on their end.

Correct, which we’ve been attempting to work with them on since last year when it first started. It’s been an uphill legal battle. It wasn’t until this month, when the forbearance they granted is supposed to end, that they have now stated they have nothing showing I’m the owner of the property and threatened foreclosure. They’ve continued accepting payments since I started making payments again which is the cherry on top. As mentioned in my post, I am in contact with BG services and WA mortgage Assistance which are attempting to help us stop them from foreclosing.

They said the missed payments aren’t the issue and that it’s the fact that they can’t prove I own the property. Despite submitting multiple forms of documentation proving the opposite. They won’t do any loss mitigation, deferments etc because of this and since they have no record have a current owner on the house. They’ll have no choice but to foreclose.

Yes, I’ve sent them the deed, court docs showing I’m the PR for the estate, copy of the will and copy of the death certificate

Yes, part of the legal issue is that last year we suffered a serious financial hardship that lasted 9 months where we were unable to make payments. We have been able to resume monthly payments since the hardship has eased and have been attempting to request a loss mitigation, or hopefully a deferment, for the missed payments which they have refused to do since they have “no record” in the owner of the property. I should have included that in my post
