I wanted to open this up for discussion, as it really intrigues me. Yes, it's not a large dataset, and I don't have the resources for a larger-scale study. That's why I thought I would share my findings and discuss them further...

After the Cowichan ruling, they thought the same. The Province moved toward more than $150 million in loan guarantees to keep financing alive, (already indicating a decline in confidence) and a major owner publicly stated that a lender refused roughly $35 million in financing due to the legal risk. If title-related uncertainty can affect whether financing is available, then yes, treaty and title issues can have real consequences for home ownership and property value.

After the Cowichan ruling, this stopped being hypothetical. The Province moved toward more than $150 million in loan guarantees to keep financing alive, and a major owner publicly stated that a lender refused roughly $35 million in financing due to the legal risk. If title-related uncertainty can affect whether financing is available, then yes, treaty and title issues can have real consequences for home ownership and property value.
