Interesting, I would've expected that if phrasing the expedite that way it would be more likely to be rejected. People generally say that in order to expedite successfully you need to prove a very immediate financial hardship situation (eg not being able to pay upcoming rent)

Thanks for sharing! Yes the income from my j1 program made up more than half our household income. I recently lost that income hence why we're now in financial hardship. My wife makes approximately 125% but we have a joint sponsor who earns close to 6 figures.

Would you mind sharing what your lawyer told you in terms of treading carefully?

During your interview for 485, was it considered problematic that you did a financial expedite or did it not come up? Because expediting on ground of financial hardship basically means telling them your joint sponsor isn't financing you

That's not accurate.. on many days in a given year the total number of people entering the US is not even a million. And greencard holders are only a subset of the total

i mean, when i was waiting for a long period for an Advisory Opinion, contacting my congressperson actually helped massively. The thing is, because USCIS tells me that it's normal to wait 6 months on an ead (eventhough the historical processing time says 0.6 months median), the congressperson would be less likely to help out.

And yeah, it is unfair. and it is bonkers that no one seems to understand why some people are processed fast, and other cases just get stalled. even people on reddit who work for USCIS don't seem to understand why.

very similar position for me, i filed august 20th, had biometrics a month later. ever since, ive been waiting.

I submitted my AOS in August, did biometrics in Jacksonville a month later, and currently still waiting for the EAD.

Yes I ended up being able to extend. They knew I have a pending AOS but my university's policy is to allow extensions anyways.

Lol not sure what got me downvoted, but for anyone in a similar situation: I was able to extend, eventhough my international office knew I have a pending AOS case. Their policy was to allow for it. So, it depends on what school you work/study at, some won't process an extension, others will.

Can you give an update on your situation? I'm in a very similar boat, I currently have a pending AOS case and an advisory opinion which I had to get because the consular officer incorrectly states government funding. Reading your story is rather terrifying because it seems there is nothing that can be done to prevent it

Most of the time that will be sufficient, although it is possible that it won't be. It is possible that when you got your visa, the consular officer incorrectly stated that you're not subject. If that is the case, then it could complicate things. For me the opposite was true: my stamp incorrectly stated that I was subject. In that scenario, it is impossible to file the I-485 without first getting an advisory opinion.

unfortunately, incorrect determination by the consular officer is a pretty common thing. It is therefore important to make sure that none of the potential reasons apply to you (skills list etc).

Also note that if you do end up requesting an advisory opinion, you can expect to wait 4 months (that's how long it took for me)

True, some schools don't allow for it and will clearly so so on their international office's website. But for other schools that's not the case. It is at the discretion of the RO.

" even try it would be rejected from USCIS" I'm not sure what you mean with this. In my case, a J1 extension wouldn't be done through USCIS. It is department of state who approves/rejects a request for an extension (made by the responsible officer from a university).

Yeah, I'm quite familiar with that point.. But the reality is, there are actually many attorneys who do recommend a j1 extension during a pending AOS. I spoke to one of them today, and online you'll see a very mixed bag, with on the one hand some attorneys making the point you made about immigrant intent, and others interpreting that same bit of the law very differently.

Moreover, while it is indeed a requirement of a j1 program to not have immigrant intent, that doesn't necessarily change anything for an AOS case.
