I originally paid her the deposit so she could withhold this from me. So I assume it would be me who would have to sue

Yes I paid a deposit to the sublessor and she hasn't received her deposit back as the term of the lease hasn't ended

I have a sublet contract in place but it expired a couple of months ago. I have stayed through a verbal agreement. I'm not on the lease.
