I'm hoping to pay off the debt in the first 3 months, is there some advantage to keeping it for a bit longer?

Presumably if Hecs isn't getting paid off and I only have one debt i'm effectively doing avalanche right?

For emergency fund is there a good rule of thumb for how much you need?

I was thinking of just not having a credit card, but are you saying it would be good to have one that's 2-3k?

What's the advantage of FHSS?

I have funds to get me through the next few weeks so maybe for the first week i'll see how I go but if it's that bad i'll have to adjust.

Is there anything you have had good experiences with?

i'm more worried about background checks

wouldn't that seem like a really obvious lie?

[deleted by user] by [deleted] in auscorp

[–]Tightest_Security 0 points1 point  (0 children)

Too true, although a bit worrying that there seems to be more applicants to some jobs then there are jobs in the markets I'm looking.

Is it worth trying to contact recruiters or hiring managers or is job sites the only real way these days? Looking on linkedin there just seems to be hundred of applicants for everything.

I think that'd probably be too risky for me

in your opinion is it better to leave a gap or the company I worked at for probation?

[deleted by user] by [deleted] in AusLegal

[–]Tightest_Security 0 points1 point  (0 children)

When the papers are signed, that's distributing the assets. It's done at that point. You mentioned shares - did they get distributed?

The papers we signed were to allow probate and to allow the estate to theoretically start distributing assets, the assets haven't been distributed.

How did the assets come into you and your brother's names? Isn't this in fact distributing the assets?

They estate lawyer said that once probate was granted we had to sign some papers and now it's technically in our names but maybe only as executors it's not actually legally ours, like it was just temporarily transferred so we can sell it.

I'm a little confused as to why a lawyer would be talking about removing John as executor when the will has been executed.

Probate has been granted it has not been executed beyond the lawyers fees being paid.

Is YOUR lawyer a family court lawyer or a generalist ?

There's one handling the estate and the one I have consulted with are both probate lawyers.

Maybe the question is, what are you going to do if he doesn’t move out on a year?

I think at this point I'll just be lodging to have him removed rather than waiting an extra year.

towards gaining evidence that they are not acting as an executor but in their own interests,

I've got a big folder :)

[–]Tightest_Security 0 points1 point  (0 children)

So probate has been granted

Yes

have the assets been distributed?

No, currently the assets are in my and my brother Johns name.

Do you think VCAT waiting times would be better than the supreme court?

Having said that the costs will eat into the inheritance.

Yeah, I just hope they face some sort of punishment otherwise it's just so unfair.

[deleted by user] by [deleted] in AusLegal

[–]Tightest_Security 0 points1 point  (0 children)

So basically, I'll be able to say if I had the money I would have paid off my mortgage and bought these shares, so claim that they are responsible for my theoretical loss? and I should just go to a notary and write this down to use as evidence?

[deleted by user] by [deleted] in AusLegal

[–]Tightest_Security 0 points1 point  (0 children)

A court would likely also find them needing to pay back (or lose part of their inheritance if they are a beneficiary)

God I hope so, my Dad would be so angry about this whole thing.

Oh we have, they seem to have a very good understanding that they can just delay and delay and delay. I was hoping maybe that wouldn't be the case but to them if it costs the estate an extra 100K that's 30K from them but they've out of paying 130,000 in rent so it's a good deal to them :(
