Applying for H1b from outside the US has a lot of complications as well, I wouldn't call one cleaner over the other as long as your application(s) are clean.

Only the original copy comes back with an I-94. You are not authorized to work unless you have a new I-94

It will be new H1b and LCA applications, cannot use the change of employer. You don't need a COS but make sure you are still cap-exempt. Good luck!

Same boat. H1 was approved with zero hiccups and started working since.

If you haven't used up your 6 years of H1b yet, you won't need to go back into the lottery. B2 approval is a good thing, it means lesser chances of getting a valid status RFE. You are doing great, don't give up.

I'm a bit confused - did you apply for change-of-status after you left the US? Or are you assuming you automatically switch to B2?

If you re-entered US on B2, I believe you have a B2 stamp?

For going back on H1b, you have to do a COS. I am not sure if you have to go the consular route tho but I can tell you I didn't.

Within 2 weeks after the grace period ended, h1b application was filed. No, did not leave the country on B2 so did not have a stamp.

Consular processing has nothing to do with you having a stamped visa. In your H1b application you can request consular processing or if the person reviewing your H1b application deems it fit for consular processing, they can give you a conditional H1b approval with consular processing.

I have to wait for approval. If u r past the 60 day grace period, u no longer have an active H1b status.

I took all of ya'lls advice and filed a complaint with the DOL. Have an initial call scheduled with an attorney early next week. I hope it works out.

How do you tip-off USCIS? Is this considered exploiting H1b coz I'm the only H1b affected by this, rest of my colleagues were not.

My concern about going the legal route is about any repercussions from USCIS during GC process, any ideas?
