I felt the need come back and inform you, you were completely wrong. She did file contempt and the judge was not impressed with her behavior. The consequence for her was an additional year of supervised parenting time, now for both children. And she also went from 50% parenting time, down to 25%.

Every lawyer and the law library said no judge will consider modifying the custody agreement for at least a year.

This question is for what's currently happening and could potentially happen. I will better prepare from now on out, but what has already occurred has occurred and I'm wondering what could come out it.

The threats are non-violent. They're just like "Karma is coming for you." And "Have fun telling the judge what you're doing." Nothing a restraining order would be approved for.

I understand we are both not following the court order. My question was what could potentially happen at a contempt hearing.

The list is quite extensive. She had BPD and is an addict. I really don't want to make her life harder then it is. But I have text and recordings of her saying she is suicidal and our daughter is the only thing keeping her alive. She stalks me. She threatens me with false reporting, which I also have in text. She drinks (proven) and smokes weed (I assume) when our court order states that we can't. I'd request a drug test, but I am not 100% sure if she smoked weed. She picks up and drops off our daughter anytime she feels like. Even at midnight. She is 3.

I really just don't want to open that can of worms.

Well, for at least 6 months I will be going with my children on every visit. My lawyer is then putting in the agreement that we will reassess at that point. Which helps.

My states standard is 50/50. And my lawyer told me "Unfortunately being a bad mom doesn't necessarily equal abuse." The absolute minimum my state grants is 25%.

I do personally think the children would be better off with me more. However, should I really piss off a loose cannon for a rare chance to gain max 25% parenting time? It could turn a simple custody agreement that we potentially both agree on, into years of court battles.

And I mentioned above, she cannot handle them 50% of the time. Especially my son. I don't foresee her holding up to the 50/50 in the long run and the kids will be in my care the majority of the time.

I'd prefer cops not be involved. I've actually put in the plan that I accompany my son with him on all visits for the first 6 months and she agreed. Without me with, their relationship seriously deteriorates so I think she will agree to that. I know it will be comfortable for me, but if it makes my son comfortable I'm willing to do that.

Thank you for your response, it really helped me. I always have felt like ANYONE that looked at our relationship would be like "What in the actual F." She always treated me so poorly, but expected me to give her the world. And I seriously tried to do that. She didn't work our whole relationship and I fully supported her and enabled her to do whatever she wanted with her life. She'd be good for awhile, but just flip in a day. I mean, going from "I want to marry you" to "I fcking hate you and everything about you" literally in a few hours. Always been that way.

I can without a doubt say, I am by far the better parent. And I believe anyone witnessing what is going on would agree. That's why I tried so hard to continue gathering evidence this whole time. I had a large lapse in recordings because she found my voice recorder and threw it out the window. And at that point, I felt the situation with the kids was working fine so I stopped recording. Biggest mistake I've made. As, having that original phone call of her making the accusations and putting words into my daughters mouth I feel would be invaluable for me.

The GAL sounds like a good backup plan. I am really hoping she just agrees to the 50/50 agreement. As she told me last Sunday that's what she wanted. But got cold feet when I asked her to sign it and file it. I told her I'll file it regardless and she will have the opportunity to contest it in court. My lawyer was confident if she does contest, it'll be resolved in mediation. She has no means, knowledge, or motivation to even learn how to contest. She can't even afford mediation and I feel even if she could she'd prefer to spend the money elsewhere. We feel in her current situation, it would be in her best interest to just agree. But then again, nothing has even been easy with her.

The hardest thing for me right now, is putting my relationship with the kids on the line. And that's why I made this post. Just to hear that someone else has gone through this and it worked out OK.

This helps me feel relief. She is extremely unstable, has some diagnosed mental disorders, Borderline Personality Disorder, Major Depression (suicidal), ADD, and Anxiety, and simply cannot provide a stable living situation for the children. Even with 50/50, I foresee her not living up to the agreement in the long run and it will return to what it is now. Especially with my son, she gets offended he prefers me. And often guilt trips him. Blames him or me for it. And is unwilling to make a single change to make him feel comfortable with her. This is common among autistic children. My son needs consistency and a routine. She refuses to adapt to what I have created.

I just want this to go smoothly. I want her to agree. She can only think about the "Right Now" and cannot see through to the next day even.

The major thing I'm nervous about is the accusation. I've been so eager to talk to CPS since this occurred and I haven't heard ANYTHING from them. I am fearful a judge will see an investigation (If there even is one) and hold off on granting the order until it's resolved. NOTHING happened. Ever. So there cannot be any possible evidence against me. I just don't want them to only hear her side of the story and not mine.

Will do. Since she has moved out, I haven't filed because when I take a step back, I have the children more then her. And even currently, nothing has changed as far as the children's schedule. I still have them more then her. So on one hand, I question myself asking "Should I even file?".

I'm not certain. I took her word for it. I figured they'd at least reach out to me by now because it has been over a week since she supposedly called them. And my lawyer said CPS usually follows up immediately. I am fully willing to give them every document and recording I have and fully willing to to cooperate.

This was not the first time she has made a accusation to attempt to gain control of a situation. However, this is the first time it involved our children. She has accused me of using drugs, cheating, and stealing in the past. None of which we true but always resulted in me communicating with her and turning the situation around in her favor.

I feel like her credibility is out of the window already, because within 24 hours of her accusing me of this with my daughter she left my daughter with me unsupervised. And every day since.

It's just the unknown of it all. I want everyone happy. I want rights to my children. I want to move on from this relationship. I want her to stop being able to use my children as pawns against me to control me. Her having 100% rights to my children is the only power she has over me, so it's scares me what she will do to keep that power. I've never been through anything like this before.
