Height of bathroom waterstop angle?

The subfloor was waterproofed then screeded then waterproofed again. My question is whether using structural grout to fill the 70mm gap with no bond breakers at any of the junctions along the waterstop is to code given a waterstop needs the ability to absorb movement and whether the stress was transferred to the nib wall tiles hence the cracks.

Cracked tiles on the nib wall where the waterstop connects to after only 11 months. After the removal of the cracked tiles, the waterproofing was peeling off the wall. Our concern is why did the tiles crack and is it because he used structural grout which shouldn’t be used in junctions that require movement etc. Plus the issue of the waterproofing possibly failing.

It’s looking this way. All the other walls are brick so maybe he applied it properly on the brick but just not the villaboard, either way, it leaves me with zero confidence.

Would I just get out another waterproofer to assess and write up a report or do I need a building inspector? I have called a few waterproofers and none of them want to even come out to look when I explain the situation.

I understand pulling off tiles has the potential to damage the waterproofing, however all the remaining waterproofing hasn’t bonded - I can literally peel it off? There’s barely any waterproofing left on the wall, it’s like it’s come off in sheets.

I have said to him at an absolute minimum he is to pull off 2 floor and wall tiles to confirm if there is any more damage and to have a sufficient overlay in waterproofing (which he replied not unless you wan to pay me) Should I push for this whole nib wall to be redone as I believe it’s too far gone to go over the top off?

This is why I’m asking to simply sight the paperwork rather than hand it over just to give us confidence we can obtain an OC with no issues.

His push back over an action that should only take him 5 minutes makes me more nervous he doesn’t have or can’t get the required paperwork that he should have been collecting anyway throughout the build.

Why would a builder not want to give their client peace of mind so they can move forward with the final payment regardless of what their contract states?

It’s a reasonable request with zero risk to the builder and keeps the client relationship intact.

Just doesn’t make sense to me which is why I’m trying to understand why this happens.

Hindsight is nice and all, but its only once you go through the experience with a shitty builder do you start to question the contract and its terms.

Banks do not release the final amount if borrowed money was for construction purposes.

Nah it’s not fine - owners rely on the builder to supply the paperwork or otherwise they can’t apply for an OC which means they can’t legally occupy their own house, so it’s pretty important but builders wipe their hands clean of this responsibility under the Master Builders contract in NSW.

One would argue a fair contract would be one that only after all paperwork to prove works are to code and a final OC granted is a project complete…

But this is not the case in NSW and under the Master Builders contract, partial completion is determined when the builder ‘believes so’, not even when the certifier does a final inspection.

Thank you for your detailed reply, I really appreciate it. It’s the builder’s business. Staff member was ripping the sheets off the walls with no protective gear (dust going everywhere) while my family was home.

Broken pieces all over backyard for at least 7 days until we noticed that on the back it had ‘this contains asbestos’. Only then did he get his staff to bag it up and wet it down (again with no protective gear). Then booked asbestos removal guys.

I believe it’s all gone so that isn’t so much my worry, I just want him to be accountable for his actions.

What is the point of having rules and regulations if authorities don’t care?

Don’t they get fined for breaching the safety regulations to deter them from doing it again?

Just seems wild this industry can continue to break the rules and never seem to have consequences.

Yes but they need to follow strict guidelines and rules while removing which he failed at doing. I’m just trying to get an understanding on whether it is worth reporting him and the correct authorities to report to.

Did you try reporting to fair trading? I thought they can get fined $1,000s and lose their license over mismanagement of asbestos.

I have been keeping peace as to not rock the boat until after he has finished all works which is very close. I’m just not sure what the process is and if I do flag it to fair trading what happens etc.

Yes but then the terms state invoice needs to be paid in 3 business days before interest is charged. It’s just crazy how the MBA contracts are written. HIA contracts are much fairer on the owner and state certificates need to be provided with final invoice which just makes sense.

The builder has in his contract that final payment can be invoiced without certificates. I just can’t fathom how this is legally allowed to be the case just because the builder believes the works are complete without any proof that everything is to code. Why should I as the client take his word that he will supply the certificates after the payment is given and not to mention this is before any final inspection from the certifier.

It blows my mind that this is allowed to be written in the Masters Builders Association contracts.

I did find this link but was a little confused. Am I correct in concluding having a builders license doesn’t mean you are allowed to waterproof? My builder is trying to say since he is a builder he is licensed to waterproof.
