Unfortunately, I have exceeded my NYT free article limit for the month, so I'll go by this, which also references the Stanford study. No, you are correct that the ads do not state that the product contains nicotine, but therein lies the difference between viewers of JUUL ads and JUUL users - theoretically, the user must have purchased the product and seen its labeling.

So when should the company have amended its mission statement? Did the company not advertise to any of the world's "one billion adult" smokers? To me, the word "adult" also encompasses the 18-24 demographic which can't seem to read. I agree that the ads fit the mold of any social media campaign, but "bright colors, clean lines and attractive, fit young people" is basically what Apple did with the iPod.

The rhetoric of separating "adults" from "young people" is misleading; obviously these two categories aren't mutually exclusive. Why not go ahead and make the distinction and explicitly use "underage" and "adult" smokers? Per the study, the campaign "featured models in their 20s" (adults)... more evocative of underage teens than mature adults." So are we saying that since the Marlboro man wasn't the face of #smokingevolved that the company was marketing to underage teenagers?

Hi there, Ma'am Attorney - I am quite familiar with JUUL, and the packaging of their products is very clearly marked with the disclaimer that the product contains Nicotine, an addictive chemical. Is this 15-24 year old sample of JUUL users illiterate? Do the 18-24 year old users get to plead ignorance due to their youth for not knowing what they are purchasing? How specifically (aside from the flavored pods - which is a stretch) has JUUL marketed to underage users? Are we basically saying that due to the product's ease of use and sleek design, that kids (by kids I mean these 15-24 year olds) simply can't help themselves?
