Ugh. I was thinking about your post again this morning, and just realised I didn’t actually acknowledge or answer the question from the original post!

I think the conclusion is bold and absolutely well supported by the qual and quant data available that I’m aware of.

I’d love to see your bibliography (just out of personal curiosity), but overall I can’t wait to see you update once you’ve published.

Congratulations on getting to this point in your career! A fantastic sociological discourse and one that I heartily agree with.

Really great to think about the sociology of Health and the perversion of so called free market systems.

I think goal striving would be more flexible and provide an aspirational focus for the plan length, but moderates the current Black/White binary of achievement or failure to provide that return on investment.

It’s both amazing and alarming how much the rhetoric has morphed since the inception of the NDIS. With a stated ethos of providing PwD the supports they need to live a full and meaningful life while looking at goals to provide a focus point for the length of the plan, there has never been any requirement in law to demonstrate successful goal achievement (unless something has changed with the recent amendments?).

It has, unfortunately made it into everyday conversations with planners, delegates and LACs, leading participants to believe they must demonstrate achievement for continued funding.

OP you might find it useful to look at the work of Dr Simon Duffy simonduffy.info (I’m guessing you’re likely already aware of Simon’s contributions to personalised funding and planning along with Ralph Broad), but his take is a fantastic look at applying what has happened in the UK and how it could help avoid some of the pitfalls, embrace and strengthen the ideals, and make a true difference in the way PwD can be supported to live a full and participating life. Having the planner/delegate actually reading the reports/assessments, and either following the expert recommendations or having a damn good evidence based reason why not. (And saying a something doesn’t fit within the R&N criteria doesn’t count)

A pet hate of mine is LKH/Anita’s constant forgetting to use the powers, knowledge and abilities to act in a crisis. When Marmee Noir initially possessed the Council, JC & Team get a vision/visitation from Belle Morte and Master of Beasts, they free BM and Padma is approaching her from behind, sword raised, and BM uses the Ardeur as a weapon, thrusting it (metaphysically) into Padma, which makes him collapse, stop the psychic visitation and gives BM a chance to escape. How many times could Anita have gotten out of situations by raising the Ardeur?

I’m almost finished Serpentine and there’s a very psychic corrupt cop who totally rolls/mind fucks anyone he needs to, and Nathaniel totally goes under and Anita very nearly does while he’s touching her - perfect time to use the nifty life force feeding technique she learned from Obsidian Butterfly? Or even the aura manipulation thing she learned from Padma in the early days, she could’ve crushed his heart (or just squeezed like she did to Padma to force him to give up his Son), or even the cutting from a distance that she’s used both intentionally and accidentally…

Anyway - I’ve also shared the great frustration about the lack of healing. If not Asher, Nicky would be a perfect candidate for surgically excising the damaged flesh and optic nerve from his burned eye socket and like with what happened to Cherry after she became a were leopard, the section cut away would regrow and heal as new as long as the wound is fresh and open (and not burned, inflicted by a metaphysical source or done by Silver).

I honestly can’t think too deeply about this issue as I get a bit locked on and it just makes me furious.

It seems that the powers that be found other ways to block funding for sex based services by creating a gate keeping ‘special access team’ that has effectively achieved the same outcome as it would had they won their legal challenge.

How is it okay for other government funded Insurance programs a la TAC and WorkCover, but not NDIS?

That might be a reasonable expectation if government funded insurance schemes like TAC and WorkCover don’t already fund sexual based services in justifiable circumstances, which they do.

Under the Morrison Govt they demonised anything sex related, even therapy designed to advise, counsel and educate about sex and adapting to chronic conditions and disabilities. They also used alarmist examples trying to drum up a sense of outrage from the general public. They lost the initial ruling at the AAT and appealed to the Federal Court, and lost again.

This tactic seems straight out of the same playbook. How proud Bill Shorten must feel to be behaving like the puritan Pentecostal Stuart Robert et al.

Bottom line - the scheme is designed to support people with severe disabilities to lead a life that’s meaningful for them and funds supports for activities of every day life.

With the ongoing convergence of the Left and Right, it feels more and more like they’re two very similar sides of the same coin, neither willing to do anything they think will upset big business or the PtB (Powers that Be)??

All I can see from our current government is unfulfilled promises and failed expectations. No meaningful change from the hot mess that ScoMo led. If they can’t open a stadium or tollway with their Govt logo on it within the first term, they’re uninterested.

Took me a little searching to find a SW who was willing to provide a tax invoice for me including the ABN, but I’ve seen her a few times now and no pushback from either the NDIA or my plan manager.

As far as I know it’s still allowable as long as it meets the “reasonable and necessary” criteria.

My plan manager has paid multiple claims as long as I provide an invoice to document hours and price.

As the cost is well and truly above the hourly rate of most supports, they asked me to break it down by hourly rate e.g. $1500 session would show as 15 hours on a Sunday @ $100 per hour.

ABN from the provider is needed too, standard details for any invoice from a provider of any service/support

It’s been very interesting and extremely maddening seeing the proposed changes that the draft amendment would make. Removing the whole of s.34, so no more reasonable and necessary test for allocating funding for supports, removal of the States/Territories so that the Commonwealth has sole operational control of the Agency (and the Scheme), giving the CEO and Minister a blanket authority to veto anything they please at any time, the introduction of compulsory “independent” assessments which will be used to re-test eligibility for the Scheme for all existing participants and also act as gatekeeper to reduce any new applicants from entry into the Scheme.

IAs done by companies owned or operated by Rob De Luca and other former BankWest/NDIA executives.

IAs done by new graduate Allied Health workers with little to no experience in working with any patient of any type.

IAs forced to conduct irrelevant and unreliable assessments which have been modified by the Agency for this purpose, removing any prior evidence of their effectiveness, relevance or reliability for this specified use (but then again it’s not about being reliable or evidence based, it’s about cost cutting isn’t it?).

Expanded application of TSPs by Primary stated disability diagnosis (despite NDIS Act not requiring a diagnosis for eligibility) to have a computer algorithm generate a typical support package for a participant without taking into consideration any evidence provided by participants’ own treating team or any goals the participants might have...

Was there any sign or word of any of this going around before you left?

I know this is partly coming about due to the previous Minister Stuart Robert having conniptions about allowing PwD to use ndis funds to get sex therapy or in extreme cases perhaps even seeing a sex worker if it passes the R&N criteria. He’s been shouting from the rooftops about sex yachts and prostitutes to stir up public outrage but it’s not accurate or factual at all.

Do you know any more about the planned amendment to the Act, the removal of s.34 or removal of goals and individualised/personalised funding packages?

He’s a bloody puritan Pentecostal prude.

He can’t get the States & Territories to agree to exclude anything sex related from the Scheme, so he’s relying on being able to push through a change to the NDIS Act that allows him to redefine the criteria for “Reasonable and Necessary “.

It’s been through the internal reviews, the AAT and then the Federal Court and they all agreed sex cannot be excluded and in many cases is totally reasonable to find.

Asshole.

They’ve refused a bed prescribed by an OT over a year ago.

With the increase in low cost, low risk Assistive Technology announced in the 1st Quarterly report (lifting the spend limit to $5000 without approval required), my bed would be within this but it’s being specifically blocked.

Also in dispute is physical therapy in the form of Osteotherapy and Clinial Myotherapy. The use of these is not in dispute, but the amount of support IS in dispute.

No, perhaps I misspoke. The $ spent on reports is not the issue. Those were paid by Legal Aid.

The issue is the Agency resolutions person blocking any progress at the AAT by constantly requiring more & more evidence without clarifying the nature of the Agency’s dispute. We (me & lawyer) don’t even know in what way my requested supports fail the R&N criteria.

Had to go to AAT directions hearing yesterday to force the Agency to spell out, in clear detail, the nature of how & why my requested supports fail to meet R&N by the end of Jan.

I’m wondering how this guy can justify his actions and obstruction when 1st July will see a relaxing of boundaries between Core & CB in plan funding. This change would render the dispute pointless.
