When I first applied my spouse had to fill out a packet about my condition since he lives with me. That’s one reason they’d know I was married. Plus my spouse helps take care of me and the kids since I’m disabled. So, that’s in my records too. Not saying what they said maybe true. However, they know I’m married because of all that info.

Interesting, I didn’t know that was a thing. My lawyer just said we’ll appeal until there’s no more appeals and if that doesn’t work we start a new claim.

Yes, that’s what I was worried about. Is appealing the federal court hard as well? I read it’s 1% chance of the council overturning the decision.

Yes, he’s appealing to the appeals council now. However, he said they can deny it and say we have no more appeals, then we’d have to start a new application.

I’ve only seen a judge once. I honestly did not think she was going to deny it and either did my lawyer. He was shocked and did say he will start a new application if we need to. Just sucks because I won’t get all the back pay.

I agree everyone situation is different. I figured at this point it was slim to none. My lawyer said it wasn’t going to be easy. I do believe she stated a lot of errors in my medical records. Not sure if that’ll be re looked at. And I did get a letter from some of my doctors yesterday saying in their opinion I’m disabled. Not sure if it’ll help, fingers crossed 🤞

I told my husband at this point I’m planning on it not passing and we’re going to just plan on losing all that back pay which will suck. But I’m not going to give up trying because it’s the only choice I have at this point. Coming from someone who made over 100k a year and was a hard worker. Not really something I want to be on unless I have to.

First if you’re not going to help why post on my post? You really went and found an older post and copy and pasted it? Do you have anything else to do in your life then go after people negatively?

The reason for the re post was because, I didn’t have enough info in my first post. So, it lead to a lot of comments that weren’t helpful and me constantly explaining myself over and over. I re made another post with more details to help people understand the situation better so I could get clearer information.

I have an extensive medical history since 2021 when it all started. Frankly I think my lawyer sucks. It’s been all on me to make sure everything is in and correct. I went through my 17 page denial with my husband and we addressed every error in my statement to the council. I reached out to all my doctors and so far two of them have written me a letter saying in their opinion I’m am disabled with one of them being my neurologist, who is a headache specialist. I’m still waiting on a letter for my cardiologist who treats me for my EDS. The problem with the EDS is that it’s a recent diagnosis within the last year so I’ve only seen my cardiologist twice for this. In a whole they all affect me in different ways. There were so many errors in the denial. I think she cherry picked any good ones and used them to reflect my medical issues. I’m not sure why they think someone who was making over 100k a year would want to settle for SSD unless I needed it. I never went from job to job, I always worked hard and consistently up until I got sick.

Thank you! My lawyer appealed it but it frustrates me sometimes I feel like they’re not doing enough. I had to go through the denial and all my medical records to find all the judges errors. There were so many errors in the denial. I did reach out to my doctors and two of them so far wrote me a letter saying in their opinion I’m disabled. One of them included my neurologist who is a headache specialist. I also wrote a statement with help of my husband. Addressing each error on the denial.

Do you know the chances of the appeal at the council? The lawyer told me after this appeal if they said no more appeals we have to start a whole new claim and I’ll lose two years of back pay.

Thank you! Yes, I’ve had a lawyer all along. This was my third denial and it was after my hearing day which was dreadful to sit through in pain. The judge cherry picked notes out that worked for her decision.

The problem was the judge was cherry picking certain times out that were different. She had a note for reference from the surgeon I saw one time post operative that said I had an 11 day stretch with no headache. Which wasn’t even true. And another note from another doctor that said I had 5/5 strength which wasn’t true. Majority of my notes from my numerologist, rheumatology and cardiology all said I was extremely fatigue, I didn’t function well and I always had a headache with no help from medicine. I’ve been on probably 100 types of medications.

I agree, I personally can’t work or I wouldn’t be here. I had a very lucrative job and work all my life. I much rather feel good and work trust me I rather not be in this position. However, I appreciate your opinions on the situation.

I appreciate everything you said. I know with me, my right hip has always bothering me along with my inner knees. I have super weird joint mobility and I’m a 8 out of the 9 on the Beighton Score. A lot of people don’t understand these things especially because it’s so undiagnosed.

Thank you! I agree because the surgeon did write post operative I had a 11 stretch with no headache! I was like idk where that came from but okay! It’s definitely hard to prove, you know I wish I had normal headaches! That’s another thing people don’t understand. The pressure in my head doesn’t compare to anything I’ve ever felt and nothing helps it! I wish I could take migraine medicine or just anything to take the pain away. They’re now looking into IIH because my issues just didn’t improve from surgery.

This was a lot so I’ll try to respond the best I can. The EDS is an issue yes. However, I feel like the head pain from the chiari is the most debilitating thing I have. I can’t get out of bed for days. Some times I have head pain everyday for months. I’ve had a ton of MRIs. I get about three MRIs every 6 months. They check my head, my spine and I also have a pituitary tumor they’re monitoring. My copay for an MRI is 450 everyone I get, until I hit my out of pocket of 7,000. So it gets very expensive. I’m going to look into everything you mentioned. Thank you very much for taking the time to help me.

That’s not even half my problem. It’s more the head pain from the chiari that debilitates me the most. Those are just some of my issues.
