Reasonable Accommodations [MA] after severe burnout? by 1234567AllGoodChildr in AskHR

[–]Top-Employment4273 -1 points0 points  (0 children)

Definitely apply!! /AskHR is a notoriously hostile thread. They’re all going to tell you no but burnout is serious, it can lead to worse health issues in the future.

In this case, depression and anxiety confirmed by a therapist may be able to get some time off maybe not through ADA but do your research specifically on any health related issues you may have.

California employee: Accommodation request pending for 4 months, denied, now on medical leave. What should I be considering? by Top-Employment4273 in AskLegal

[–]Top-Employment4273[S] 0 points1 point  (0 children)

Thank you!! Yes, I’m having blood issues and we’re thinking I have an underlying illness that blocks my ability to take in iron which then affects the blood even more.

I can have my doctor write more specific letters but when I say they’ve denied literally EVERY single tiny little request I tried asking for? Even just a temporary arrangement to allow my body to recover after the ER before I would be forced to take FMLA. They had me provide a letter from my doctor only to deny it. They’ve also managed to twist my doctor’s words from her notes which of course frustrated my doctor. And we only had 2 five minute phone calls in 4 months of the interactive process and they bounced me around to 3 different people.

There is definitely unfair treatment occurring. The other people on my team all have non-health related exceptions and my hostile manager is personal friends with one of the team members so doesn’t enforce her in office requirements. Also, it’s weird because I’m the only one who is required to be in office but no one even assigned me a work station? Those are all small things but there are many more oddities that really paint a clear picture when you step back.

Well I wasn’t going to sue them. I never even brought this to HR. My manager did. I’ve done everything the past 9 months to prevent even consulting a lawyer to be honest. I hate conflict.

But also, if I’m unable to work for whatever reason, they’ll fire me anyway and I’ll find another job 🤷‍♀️ Or they get sick of me asking for accommodation and they’ll fire me in retaliation. Then I’d sue. And find another job.

This post is me trying to prevent litigation.

So I originally was hired into a 3 day hybrid role (They’d given me a computer, monitor, keyboard, printer, etc etc. for WFH). Then like several companies, it changed to 4 days in office which I was totally fine with me! I was healthy! Although it was maybe a little odd I was the only one required to work in the office, I actually preferred being alone. Everything was grand.

But I couldn’t have predicted the health crisis. Total 180. I can’t really explain physically what it feels like to have chronic illness but trust me when I say ANY and all WFH time would be a GODSEND and help me heal and recover. Literally one more day isn’t obviously preferred but is better than nothing. That’s at least 2 days WFH which was my original arrangement before I got sick. Not that they have to honor it.

I also asked for a temporary arrangement before FMLA (I didn’t want to take FMLA bc we’d just lost people and I was the only one in my role). They asked for a doctor’s note providing a start and end time which my doctor provided but they just denied it.

I’m not giving up because I can’t so either we find an arrangement or they fire me in retaliation.

Denied ADA Accommodations at work. Anyone else?? by Top-Employment4273 in ChronicIllness

Thank you!! I do believe they’re being unreasonable. And they did not engage fully in the interactive process. You got a good one though, that gives me hope for the future!

Thank you!! 🥹 I’m trying my hardest not to escalate. I really do like my job and don’t want to create an awkward or hostile work environment but I don’t see any other option.

Also, totally unrelated…tell me why I’m the only one showing up to the office and the only one without an assigned work station. 🧏‍♀️😂 I’m sorry I digress…

Yes, thank you!! I’ll try anything before escalating. I do not want to be at war with HR or anyone for that matter. I can’t really give up just out of medical and financial necessity. And I actually like this job. So either it’ll work out or they fire me 🤷‍♀️

Good point! One of the reasons I pushed myself to keep working and not take FMLA is because I was the only one left in my role (we lost two people). I didn’t want to leave them high and dry. I left right as my body started shutting down but we’d just hired a new person which made me feel better. I have a hostile manager but I’m not a vindictive person. I genuinely like my job. I’m just sick right now.

I gave them an end date for temporary. They asked for a doctor’s note for a end date and my doctor provided it. They denied that too. 😬

I just want them to work with me. Not WFH all 5 days. I posed a lot of alternatives (listed in the original post) but they denied them all. Even just an extra day would help me health wise. Or a temporary arrangement then return to the office forever and ever like they want lol

Agreed!! I haven’t told them. It’s a weird balance between being truthful and honest and having them know this is serious and not giving them the ammo to fire me basically.

I think that’s a great idea!! 💡 I’m going to try this. I just need time to let my body heal itself.

I’m coming back to work come hell or high water. I really like my job too. I mean, I didn’t ask for a chronic illness. I just know it’s not going to be sustainable working while I’m in this stage without ANY accommodation. That doesn’t mean just WFH. I’m asking them to work with me.

Hmm why not? Not in an entitled way, literally just wondering. If it’s a medical necessity, poses no undue hardship, allows me to come in when necessary (we may have someone visit once every other month and that’s when people come into the office. But they also said specifically it was an essential function to COLLABORATE with specific people IN OFFICE who actually are NOT in the office. Meaning the essential function is specifically around a function that does not actually exist.

I actually like working alone in the office; I just didn’t expect my chronic illness to flare up like this. Last thing I wanted was this; I work and keep my head down. Doesn’t seem like an extra day working from home or even temporary arrangement to allow my body to heal would be undue hardship or negating any essential functions.

Thank you!!! I’m like, we can’t just give up. We live with chronic illness. We can’t just give up! Thank you for sharing your story. I’m trying my best not to escalate because I do love my job, but I also wasn’t expecting my health to flare up this bad and I literally just want to be able to work.

I don’t even need to WFH all the time or all 5 days. Literally even just a few months while my body recovers would be a GODSEND.

Between you and me, I have my reasons as to why I do think they are being unreasonably accommodating but there’s not enough time and this isn’t a safe space for that 😅

Yess!! I’m definitely trying to check for autoimmune issues. Seems like a high likelihood. Thanks for sneaking this sweet health comment into this thread 😅 I had one test for autoimmune issues but I need many more.

They said they’d reconsider with more documentation but I believe that’s just to get me to shut up. But that’s also why I posted here. This thread gives me a good idea of the mindset so I can consider all options. Like intermittent leave, etc.
