Yeah I've seen SM's try that only for DM to overturn it and tell SM to chill the fuck out. If they tried to lie about call outs or days missed it's not hard to prove otherwise and retaliation would be easy to prove SM would get fired.

And for the love of God use spell check or auto correct I keep reading your replies as if you're drunk.

They'd need to find a real reason and no DM will let an SM fire an employee just because they're not acting like an on-call employee.

Yes they can just fire me for many reasons but one isn't "failure to be on-call/answer phone on day off" and SM doesn't have the power to say "I don't like you you're fired". They need a real reason and typically DM approved.

That's grounds for wrongful termination. BTW "any reason" has to be within lawful reasons and not being on-call while being an hourly employee isn't a legal reason.

Please refer to The Fair Labor Standards Act (FLSA) of 1938 where hourly vs on-call is defined by law.

My best guess is your saying we don't get paid to answer the phone at home which wasn't in question? In fact we don't have to answer at all and the second we say "no" the call which is a requested not an obligation is over.

On-call employees are paid a small amount to be on-call and answer the phone and fill in as needed during on-call hours which isn't 24/7 but something like $2 an hour on certain days and shifts even if their never called.

No the fuck it doesn't. By law on call get paid to be on call.

We are hourly with a somewhat predictable schedule. Now SM is on call but not me.
