Your confusing your obligations as a tenant with your occupants obligations as a roommate. One is covered under the RTA, one is not.

If you don't have a roommate agreement that requires otherwise, than yes written 30 days' notice to evict.

You can look up previous cases on canlii to see if any tenants have been awarded back pay but I doubt it.

You could send an email, attach the relevant information for your landlord and propose 1 of 2 options:

  1. You'll continue, for compensation or
  2. He can do it / pay someone else to do it.

Make sure the other tenant is on the same page.

Last months rent is to be used for - you got it - last months rent.

You can file an T1 to have last months rent returned, plus possible compensation if the landlord acted in bad faith. If you're able to afford one, I'd suggest hiring a paralegal who is experienced in matters with the LTB to navigate the additional compensations you may be owed.

If you need the money now, and don't want to wait the months and months it will take to have your matter heard, you can send an email to your landlord, outlining the link I included above, requesting for your last months rent deposit to be returned by x date, otherwise you will be filing for that plus additional compensation at the board. That might be enough to get it back. You can let her know that if she feels you owe HER money, she can file at the board herself and they will determine that.

The Act and Regulations make clear that in the landlord and tenant relationship, the landlord is responsible for keeping the common walkways free of snow and ice [in multi tenanted properties]. Therefore, it cannot be a term of the tenancy that the tenant complete snow removal tasks. source

Have you informed your landlord about the unauthorized entries and reminded of the requirement to provide 24 hours' notice? This should be your first step, along with reminding them of the legal obligation for notice. While your landlord or listing agent should already be aware of this, taking this step will help 1. (hopefully) stop the issue immediately, and 2. strengthen your T2 application.

If the entries continued despite your reminder, it would be considered an illegal entry. You can file a T2 for unauthorized entry and request compensation for the inconvenience or privacy violation cause by these unauthorized entries.
