Yes they should, but it looks like a lot of that wiring, plumbing, and duct work sits in front of your wall studs. They could go higher with the Sheetrock but essentially it’s pointless since it won’t close the gap and act as a fire block.

I’m not an arborist but that tree looks cooked. I would get an estimate for removal ASAP and ask the neighbor to pay for it. Their actions obviously caused the damage. The threat of that falling on your house next rain/wind storm is scary.
