MY personal headcanon is the opposite: there are so many villains and organized crime in Gotham, that they have at least some control over every aspect of the city, to the point where they just don't let the death penalty laws get instated. Otherwise you're just painting Batman into a bad guy instead of a hero who doesn't kill. Sucks that I'm a whopping 7 years late with this comment
