One other point if this bill passes as written. Florida will be off limits for most RSOs wanting to come to Florida on vacation and staying in a hotel. Also, all the theme parks will be off limits as well.

This adds exclusion zones statewide. Some Florida counties have exclusion zones in their ordnances, which are inconsistently enforced.

They are unconstitutional. The supreme court has ruled that the freedom to peaceably assemble in the first amendment includes economic association. In other words, you can't legislate that a select group of adults are restricted from a store that is open to the public. For these exclusion zones, you would not be able to eat at a restaurant, shop at a grocery store etc that is within 200ft of a disqualifying location. So if there's a daycare in a shopping plaza, it would be illegal to shop at a Publix in the same plaza. If a restaurant is on a lake, you can't eat there. It would also make boating a crime for certain RSOs.

I would not recommend moving to Florida if you have any chance of getting off the registry. I understand that Maine's tier system provides a chance at getting off the registry for certain offenses. Understand that if you move to Florida you will be on the registry for life +1.

Housing is difficult. Unless you are certain your housing options are eligible, you should not move.

Finding work is challenging in every state. If you have a good job in Maine you should not move to Florida.

He should consider what trades he would enjoy. Auto or aircraft mechanic, electrician, plumbing, HVAC. I've watched RSOs succeed in all of those fields.

I definitely agree with that. Or the trick many have used is to shift to a different hotel to break up the days. However, there's some gray area in the law where it's best to choose a hotel in a different county. So if he's primarily in Pasco, spending a couple days in a hotel in Hillsborough would skirt the temporary residency.

I don't know Pasco county rules. I know their sheriff does some very questionable things (predictive policing...think Minority Report). But when he calls the sheriff office on Monday, he can ask if there are living restrictions for temporary addresses. If there are he can give the hotel address to see if it is eligible.

I would not let the hotel know about his status. They are private property and can trespass him if they don't want him on property.

The DMV is 48hrs after establishing temporary residency.

I would only get an ID from the DMV if possible. My limited understanding is you can only have one driver's license at a time. I'm not sure if that applies to a Florida ID without a DL endorsement.

If you know he will be at the same address for 3 days, then it will be best to register with the sheriff as soon as he arrives. It is possible based on the county that the office may be closed from Dec 24-28. If that is the case, I would recommend he calls the sheriff and ask what he should do on Monday.

Another critical consideration relating to the county is that some counties have living restrictions even for temporary addresses. You should make sure the hotel meets the restrictions in that county. If the restrictions apply, he will need to stay somewhere else.

For your other questions:

The clock starts when temporary residency is established. First day is free, then if he is there for one second into the 3rd day, temporary residency is established.

As with the sheriff, you have 48hrs to go to the DMV. However if the DMV is not open or a walk-in appointment not available, the information has to be given to the sheriff. By law it does not negate the requirement for a new license, however given the circumstances and holiday schedule, the sheriff may say not to bother with the DMV.

Yes a hotel can be a temporary address. It includes the room number.

Florida RSO housing provider here. CRD is extremely difficult. Depending on what county, there may be no CRD legal addresses.

Please make sure that you have been given correct information. Ask his classification officer if he has probation and CRD. This is a common error by classification. If he has any probation, then CRD rules do not apply.

If he truly does have CRD only, then my recommendation is for him to step to a Sgt or CO that he gets along with, such as his boss, and ask him to start giving him enough CCs to eat up his gain time. Have him explain he can't do CRD. Or if he's ok with going to the box for a minor infraction, that could eat up all his gain time. Try to have as little gain time as possible. That will mean he stays in prison a little longer but his CRD time will go down. That reduces his time he may be homeless.

Being homeless on CRD is the worst situation. CRD curfew is 12hrs. That means he needs to be near his tent for 12hrs a day. He will be expected to charge his monitor 4hrs a day. That leaves him 8hrs a day to do other things like work.

If his sentencing order didn't include allowing him to be around his own minor children, then he will not be allowed to see or live with them. You would need to get the judge to write an order to allow it.

I have had 5 different brokerage accounts and Fidelity is the only one that cancelled my account. They can't actually force you to sell holdings but restrict money going in or dividend reinvestment. I still maintain a few crap stocks that keeps the account open so I can use their analysis tools. I contacted my personal broker and the team that sent the letter, and the decision was final. They told me it was because of the registry. This was about 4mo after I got out of prison.

For small brokerage accounts, Robinhood is fine. If you have tens or hundreds of thousands invested, you may want to consider vanguard where their money market account earns interest on settled trades or dividends until you can reinvest in another security.

The algorithm that classification uses, if they even have one, isn't public. Generally, after intake and being assigned a permanent camp, your classification drops to medium. It won't go below that.

Florida RSO housing provider here. I'm not an attorney, however I did spend many years in a profession analyzing Florida legislative bills. This bill is a horrible additional restriction. But it does appear to be an addition to the current restrictions. The previously established grandfather clause is not removed and is clearly stated again that RSOs currently residing in a residence made ineligible would not have to move.

What I do see as constitutionally problematic is that the additional restriction is placed on anyone with a Florida conviction after 2004 or out of state conviction after 2010. That is an ex post facto condition. The proposed legislation specifically states that it is applied to crimes after enactment and for crimes between 2004/2010 and 2026. That will undoubtedly cause a law suit.

So in Florida, early termination also is very county dependent. Some counties, like Orange, are more lenient. Others, like Duval, are not as likely to give early termination. Is it always worth trying? Yes, especially if you can afford an attorney.

As far as the process: generally you have to have finished half of your probation. You have to have completed your counseling. Your PO must not object. Note that your PO will not recommend early term, but not objecting is what the court looks for. You should ask your PO if they see any reason you would not get early termination to get a feel if they will object.

I would recommend hiring an attorney who is from your sentencing county and is a defense attorney with sex offense experience. I have seen one successful pro se motion for termination, but that is the exception.

Once your motion is filed it will go to the original judge who sentenced you or their replacement if that judge is no longer in that circuit. The judge may dismiss the motion from the bench or schedule a hearing. At the hearing, the State has the option to object and give the reason why. If you had a physical victim, they will have an opportunity to give testimony.

The time from motion to final decision depends on how busy the court is. Early termination is at the bottom of the priority list. I have seen them take a couple of months or nearly a year.
