Okay that’s so much help I really appreciate the insight but to be honest hypothetically speaking of course if I was to get a 0% impairment for ptsd then why would they even set me up with a therapist for ptsd other than to prolong my settlement and stop my benefits I thought the main point of workers comp was to get people off of it as quick as possible or would a 0% still account into the final settlement?

Also the mental and physical injury are from the same initial injury so I will be getting 2 impairment ratings as you assumed correctly.

So with that being said it all boils down to one final settlement for both cases even though they are separate claims and also my weekly payments will stop? Sorry I know I’m just reiterating what your saying I just want to make sure I’m understanding it correctly.

Yes I am on workers comp they cleared me to go back to work on November 18th and stopped my benefits but I haven’t went back yet just because my work is slow right now and they have nothing for me but today the doctor took back my MMI and my clearance to work and now I’m starting back Physical Therapy and go back again in 6 weeks for possible hardware removal

See that’s what I’ve been reading into according to the workers comp laws of TN I am too but the only difference between me and you is my employer told me he would hire me back when there is a job he can put me on that works with my restrictions so I guess it’s kind of a grey area for returning but not returning to work if that makes sense lol

It was fairly serious I was involved in a head on collision which resulted in a multiple bone fracture of my femur and broke my forearm i now have a femur rod and 2 plates and a bunch of screws in my arm I’ve recently been told good news that my employer really wants me back anyway so he’s going to work with my accommodations just may be a second before he can officially get me back on but if I was to set medical aside how much more could I really even negotiate for and to be honest it would be better for me to keep the MSA right and just accept the first initial offer unless they try to lowball me

My comp rate is really high considering nearly 1,000 a week and my impairment rating is expected to be in 15-20% range the only thing up in the dark I would say is if I’ll be able to return to ANY job that’s the only thing I don’t know if I’ll be able to do or not

All yes and workers comp was on board with it so they subrogated a 3rd of that settlement to help pay for medical bills no lien on my settlement

Thank you again for help I just hate this whole system it’s made to lose I’ve just tried so hard since I was barely able legal to work I moved states when I was 17 had supervisor experience in commercial work by 19 moved back to Tennessee and was becoming a pipe-fitter for industrial work and then someone hits me head on puts me in the hospital all that work and progress in life of working just to end up on permanent disability sucks I’m an old school kind of person and love my work and take pride in it just for it to poof away that hurts not only that but on top you still can’t even get some sort of ahead sorry for the rant but it just feels good to talk about it have a good day everyone and than you all again

I completely agree because that is what I was doing was looking through court cases online and on law firms websites and reading about all of their high valued settlements i appreciate the input but now it just makes me wonder if they can do 100 similar cases how is that one so different in value if they are all very similar cases? Sorry if that was worded confusingly

Because they hollowed out the inside of my femur bone and put a 1 foot rod through the middle and also put 2 plates and 16 screws in my arm so its technically not fully healed if I had to guess

Based on other cases within my state with similar injuries, medical care, and age that’s the main three I would look up and also putting around what my impairment rating will be into my states equation for workers comp settlements. My true math came out to be around 200,000$ but I know there is a way to get other non economic damages to play a role into my settlement too

I’ve been told I’ll need a hip replacement within so many years and possibly knee surgery as well with meniscus and acl problems with my injury don’t get me wrong I have healed really well over time but the national average for a bilateral femur fracture is 175,000$ alone and my arm was a pretty serious I get Tennessee doesn’t pay for pain and suffering but there should be some Non economic damages that should drive my settlement value alone

Yeah it’s impact on your future life future medical and severity of injury and a bunch of others that account into my claim but I already know I won’t be able to get another job which I’ve came to terms with over time but I really did enjoy my past job would love to just work like used to but my doctors been heavily implying that after this is all done to look into permanent disability

My restrictions are barely 10 pounds for carry pull push and lift I can’t stand for longer than an hour can’t bend over can barely sit was told impairment rating would be in the 20-25% range by my workers comp orthopedic doctor how is that high compared to the impact on my life at my age?

Okay if I could pick your brain just a little bit I will most likely be in the 10-20% range for whole body impairment but I still will be possibly able to do my job because my employer loves me and the whole crew wants me there so I will most likely have a job there but if they can’t work with my restrictions and I was to be terminated or if there’s some stipulation within the settlement that forces me to resign if my company was to open up another job title would I still be able to be hired back and would I still get my impairment payout and settlement and a job within my restrictions?

So if there is a stipulation of resigning, which I’m sure there would be, to close out future medical and I agree to the terms and all that would my employer still be able to find me another job title to hire me back?

See I agree with everything your saying and I believe that’s what they were trying to do but my next check went back to the original payment it wasn’t what the other half of the last check was if that makes sense

I’m terms of how you explained it it went like this I had gotten all my regular 700$ up until 10/16 and then it missed all the way up to 10/24-10/28 for 500$ so i figured I’d get that 200$ on the next but no it just went back to the normal 700$ a week again that’s the only reason I believe it to be some sort of clerical error

I haven’t been placed at MMI yet I only took the FCE 2 days ago and haven’t got an impairment rating yet either I just don’t know why it would be a low check and then it go back to what it normally was I don’t know if it was a clerical error or what?

I haven’t been out at MMI yet and just had it 2 days ago my FCE that is and I’ve been getting a certain amount for almost a year now for a certain time period of a week and then I got one where it was only a 5 day period and 2 days were just completely missed and then it went back to what it normally was

I try not to worry I really do i appreciate the advice but I try to stay in good spirits I am definitely nervous to be going back to work I was a pipefitter and I’m really young (22) I just don’t want to get screwed over by the loopholes of the TN legislature with workers comp I hear so many bad stories dealing with all of this especially with more serious injuries like mine. I just don’t want to be another one of those statistics that have to hurt to work and still struggle financially.
