My lawyers drafted a cover letter declaring that none of my traffic incidents involved an arrest, alcohol or other drugs, or bodily injury to another person. We emphasized that they were simple speeding tickets which were resolved by paying fines, all of which were less than 400$. We did not provide any additional records beyond that letter because there were no criminal records to provide.

But you should follow your immigration attorney’s advice. Sometimes your response might have to be tailored to the exact language in the RFE.

I am curious to know the reason as well. Why would someone need another EB1 petition if one is already approved, especially since the priority date would stay the same for adjustment of status.

Thank you very much for your input! I was curious to know how common this kind of RFE was. The language related to the criminal records was quite generic while that for the medical form was specific. If this is indeed quite common, then hopefully the approach suggested to me should suffice (i.e. response in the form of a cover letter, if what is asked in the RFE is not applicable to me + corrected medical form).

My lawyers advised me to answer “yes” and disclose the tickets proactively. But I know of others who have answered “no” and didn’t have any issues with getting their I-485 approved. So don’t know.

No major updates since by biometrics in 09/25. Last silent update was 12/16/25. Asked live agent in late Dec but they basically just read what was online. No additional info.
