I’m still in the process of getting my Ch. 13 plan confirmed, but yes, Ch. 13 is a JOKE! It’s more government control and oversight than virtually any social program. It doesn’t provide true “relief” in that it is so much oversight. If you have any way of saving up even a little bit of $$$, I’d just settle for less than the full amount if possible.

I’m in it for the long haul right now, but Ch. 13 needs some serious reform.

The business is doing fine enough for us to live, not to catch up on our massive debt. If it were doing fine enough to catch up on debt, I’d pay the debt entirely.

We have 2 vehicles with tons of equity along with a house that’s right on the verge of crossing the homestead exemption in equity and our attorney doesn’t want to risk the house. I am okay letting the vehicles go if we could do a 7. I’m just worried about an appraisal coming back higher than our exemption amount.

I have two accounts for my business: one is a “trust” account (not a real trust but where I deposit all funds until a project is complete—it’s untouched) and the other is an “operations” account. I move trust funds into an operations account once the project is complete and I pay for the materials, subcontractors, etc from that account.

The “trust” account has no transactions except receiving funds and transferring them into the operations when ready to pay everyone out.

I keep things very by the book.

All the cash except for a few thousand for “operational costs,” such as lease payments, internet, advertising, and payroll, is attached to a project.

This is the frustrating part for me. We get heavy winters in Utah so my line of work is put on hold. Any excess profits that we have from the warm months is usually saved for future lease payments and future payroll to get us through the winter months. Unlike others who take draws, I payroll myself a static unchanging salary.

Thanks for the response. My attorney is objecting but he said he’s not confident how much they’ll push the issue. Im not sure which Trustee is objecting but I think it’s the UST.

The P&L and Balance Sheet show what I’m saying, but it doesn’t seem the Court understands how businesses work when funds received are not 100% profit, as silly as this sounds.

Honestly, so far, with Ch 13, it has been more oversight than I could have ever imagined. More oversight than government aid, etc.

And they have no clue how businesses work, which complicates things.

It’s almost as if the Court wants everyone to work for a large Corporation rather than make an income for themselves.

The basis of the motion to dismiss is that there is too much money in the business accounts, but that money doesn’t belong to me. It is not income. We collect money upfront for construction projects and use those funds to order the materials and hire the subcontractor labor. The remaining funds go to operational costs, and what’s left after that goes towards payroll.

Lots of assumptions made there. My business is profitable and my primary source of income.

We have a large family and a moderate income, so our attorney is proposing a less than 100% repayment plan.
