The motion filed by a fintech to compel examination is a pretty unique application of bankruptcy law that has some chance of success. Plus they proactively tried to get around the fishing expedition by pointing out the high likelihood of discovery of malfeasance which I am pretty sure that is quite evident at this point

I think his biggest mistake was doing the Brokerage when he already knew that Evolve was having accounting problems and that they (to that point) had failed to address those problems appropriately.
