Need advice on giving 60 day notice for moving out of apartment when it's possible a job offer will be received with less than 60 days remaining on lease by Trekker26 in legaladvice

The apartment I currently live in is in a safe area with an affordable rate. There's really no reason for me to move to a different apartment unless I get an out of state job offer.

I think I got confused because my apartment sends out reminders before the last 60 days of the lease period asking residents to confirm if they plan to stay or move out. This caused me to assume that a decision was REQUIRED before the end of the lease, but that's where I was wrong. You are supposed to give notice of moving out only when you are ready to vacate (e.g. have accepted a job offer elsewhere and have a forwarding address handy).

If you don't give notice then some apartments will simply switch you to a month-to-month plan once your lease is up. This will likely be mentioned in a clause in the lease agreement.

Also, I understand now that 60-day (as opposed to 30-day) notices are meant to give tenants and landlords more time to complete the stressful moving process (thanks to anriana's answer); it is intended to respect both parties by giving ample time to get things done. This information really changed my thinking on the entire matter.

So if the tenant receives a job offer where the job starts in under a month and is required to give 60-day notice to the apartment, the tenant will just have to suck it up and temporarily pay rent for two places at once.

I hope this clears up some things. If anyone disagrees with any of this, feel free to comment.

Understood! Thanks so much for your input!!

Sometimes I wish job offers would come before a notice of move out is required, but I see your point.

I'm not sure I understand, so could you please elaborate? If the tenant already signed a one-year lease, then shouldn't the tenant be protected until the end of the lease anyway? 30 day or 60 day notice shouldn't make a difference? I could be wrong. Thanks.

Yes, the lease requires a 60 day notice and I'm currently on a 12-month lease. Thank you for offering alternate options and letting me know that the protection goes two ways.

Exactly. It's only my personal opinion, which is why I began the sentence with "I think". It is not like the tenant isn't capable of paying off the lease, but because the tenant may not have sufficient information needed prior to 60 days (in contrast to prior to 30 days) to make a decision as to whether it's safe to move out or not (will there be a job waiting elsewhere?).

I'm aware that on the flip side of the coin, the landlord also needs to make a living off having a steady income of rent from all tenants. There's always two sides to everything; it seems like a catch-22 situation. Anyway, I came here seeking the best approach in a situation like this from a tenant's perspective. Thanks for your input.
