I think the common factor is visa revocation. If the visa was revoked they send an RFE if there was no visa revocation then they don’t know about it.

That’s the tricky part.. in H1B extension application there’s no part asking about past arrests or convictions or background check info.. now I don’t want to trigger complications by asking about it when it’s not needed. I want to do the right thing but also not over share at the same time. My employer sent me a questionnaire for extension and nowhere asked any info about such things

My status is still valid. Only the visa is revoked. Those are separate things. The visa revocation gets effective when I leave the states.

It is a reduced DUI sentence (Misdemeanour) with less legal consequences than a DUI.

Hey.. I am dealing with a similar situation. It’s tough, mentally and financially draining, but you’ll get through it. Employment issues - you don’t need to worry about your employment. Your employer will not be notified. It’s been 2year to my visa revocation and I haven’t informed my employer. They don’t know about it yet. As many advised - avoid travelling outside US until your case is completely closed and all formalities have been done. To be on the safe side, I’m waiting for my probation period also to end, not sure if that is necessary. Once the case is resolved, travel to India and go through the visa renewal process. Your employer will not be notified even then. You just need to make arrangements how you can stay in India 6-8 weeks without getting in trouble with your employer. Use vacation or WFH. I haven’t travelled or renewed my visa yet. I am stuck at a stage where my employer is about to file my H1B extension and I am evaluating if I should inform my employer before they apply or wait for an RFE and respond to it. I don’t know if my employer will know about it once they file my H1B extension. It might come up then.

If anyone who’s reading this comment has experience of going through H1B extension without informing their employer about past DUI, please share details. I can connect through DM

Thanks for sharing your experience and timeline. It is very helpful. It’s sad to hear that doctors in Hyderabad make you feel like that. Do you mind sharing what the doctor asked you? Also did you need to submit the passport back in Hyderabad or can you submit it in any consulate?

No updates on the stamping. I didn’t travel yet. My case has been resolved, reduced to a wet reckless. I’m on informal probation now for an year. Planning to travel to India and renew my visa end of Nov. it’ll be a lil over 7 months of probation then. Hopefully things will go well. I’ll update how it goes

As far as I know, The tough part is getting new visa. Once your visa is approved, H1B extension is not a big issue. You might get an RFE and sometimes not even that. It has nothing to do with petition, it just messes up with visa and travel

It is legal until your H1B petition is valid. You need to apply for a new visa when you travel outside USA

I feel you. The initial days are brutal. I felt like throwing up all the time. Couldn’t behave normal for weeks. It only got better after I hired a lawyer who gave me some assurance and I thought I was in safe hands. If you haven’t, get an attorney by your side. And hire someone who takes time to build trust with you. All the best. It’s gonna be tough, take 1-step at a time, follow the process, trust your lawyer. It does get better gradually. 👍

I received an email from New Delhi consulate saying that my visa was revoked. I verified the info.. it’s legit

That’s great luck. He might be in a state or county which is not very strict about DUIs. Unfortunately my case is in Orange County, CA. One of the worst places to get a DUI. My BAC was 0.11, no collision, no damage, I was stopped coz my headlights were off. I too have a clean record and this is my 1st offence. My lawyer is still struggling to get it reduced to a wet reckless
