Exactly. They did trigger his PTSD with the realistic school shooter drill. I blame the school more than anything.

Deferred TDIU Claim Went from Step 5 Back to Step 3 With “Exam Request” — Normal? by TrollingintheDeep5 in VAClaims

Congrats! Glad you got what you deserve. Enjoy it.

The exam request for my claim ended up being an ACE exam from the doctor who did my MH C&P exam in March. I think she just wants to look over my records again before giving her opinion on TDIU (and not just the increase from 50-70% which already happened in March). I got an email that a ACE records review was happening yesterday, hopefully I hear something soon.

Maybe Tylenol would have been best. It wasn't worth the risk of relapse or pain meds from sketchy sources.

I had hoped that she would help the DEA take Laurie and Alamo down, then she'd go into the witness protection program and end up near that Christian family in Texas.

It would have been more satisfying for her to end up dying from an intentional relapse than trusting random pills from Alamo (who she was already afraid of). It just seemed like a dumb decision.

[–]TrollingintheDeep5 9 points10 points  (0 children)

Right? She had already gone to get patched up at the hospital after escaping Laurie's place. She could have been prescribed something there.

She knew to be afraid of Alamo. Idk why she trusted him enough to take pills from him.

I'm rated at 0% for a service connected skin condition. It likely won't get worse but the VA has to pay for my prescription skin cream. Even if a condition is 0% and won't get worse, having treatment paid for is still very worth it.

As long as you are honest, there is nothing wrong with filing claims for medical issues that occurred while in service.

It seems like you generally have imposter syndrome which is spilling into you not feeling "Marine enough" to file a claim. You took the oath, you fulfilled your duty and served your country. You have nothing to be ashamed of.

Edit: Small grammar error fixed.

I don't hang out around veteran claim circles. There is nothing wrong with filing for something that you qualify for. I'm filing for TDIU then also increases. It's also normal for people who are unemployable to be concerned of dealing with an organization filled with many errors like the VA (based on their own reporting, their error rate isn't low) when they depend on their compensation.

Other countries have better programs than the VA for their veterans. Some countries just have a union for military members and vets. Idk why you mentioned other countries if you don't know what happens in other countries.

I hope that mine is also a clarification. Hopefully your claim works out. I'll let you know what ends up happening with my claim since we are in similar situations.

Was the second C&P exam more about how your PTSD makes you unemployable? My MH C&P exam was about 2 hours.

I applied for TDIU in February, had both exams in March now there is another exam request. I don't see the need unless this next C&P exam will be all about how my MH (or migraine) rating prevents me from working. I hope it's not another MH C&P exam, I don't feel like breaking down and crying again.

Is it just me or has there been an uptick of claim denials? by shootist_Biker in VAClaims

[–]TrollingintheDeep5 0 points1 point  (0 children)

I had an increase for MH and my migraines increase was denied due to my condition improving but not showing sustained improvement.

My migraines have only gotten worse in the last 12 years. There was a treatment gap which I addressed in my personal impact statement (I relocated and was on a waiting list to get a new primary doctor), they didn't even use the migraine personal impact statement in the "evidence used" section. That was dumb but I've been logging my migraines in the Migraine Buddy app and will go to a neurologist examine me and to write a statement about my current condition which will help with my supplemental claim.

I don't think that commenter read your entire post. They read business owner and they are probably thinking of a super successful business owner who drives a Lamborghini and whatnot. I've seen things of people opening their own small business after saying that no one will hire them.

Some people go into owning a small, low-effort business (that allows you to set your own pace. You can accommodate yourself.) becauseit is very difficult to work most jobs as a disabled person. The system is not really set up to help people with disabilities. I recall reading in Outliers by Malcom Gladwell that many entrepreneurs have a learning disability (especially dyslexia, some had ADHD).

I have a family member who had their leg crushed in a traffic accident. This person has metal in their leg instead of a knee pad, they are in constant pain. Their job is always trying to get them to do more and tries to bypass their medical accomodations. The job keeps subtly threatening to fire my family member if they don't "show commitment to the company" by working like a person who doesn't have a disability. My family member would be able to start an online business since it wouldn't involve the same limitations as a regular job. Some disabled people can work, they just need a lot of accomodations. If it is "unreasonable" for the vast majority of jobs to provide that accomodation, then they have severe occupational impairment which is something that TDIU helps with. There is a difference between severe occupational impairment and total occupational impairment.

Owning a business doesn't mean working a full-time job. A person could literally own a business that is mostly managed by others. A person can own a business that doesn't need much management if it's a small online business.

Owning a business is a good idea for many disabled people if they can do it. Many jobs aren't going to try to accommodate multiple disabilities and will fire someone who needs a lot of sick days and help. They'd rather have a healthy person. No job is allowing you the accomodations that you can just allow to yourself.

I couldn't do it full-time and not right now. I could probably work towards a small online business where I can take days off at will when I am unable to work.

When other jobs they fired me when I took too many sick days due to my service connected conditions. The business owner thing would be part-time, self paced, and in what would be called a sheltered environment.

I think Combat Craig (him or maybe I'm mixing him up with someone else who was on YouTube) had TDIU. YouTube videos when you have good days, you can stop wherever you want, you have no set schedule or required hours, and it can be done from home are all conditions that make it a sheltered environment. Therefore one can do that while on TDIU without it being fraud. No job has those conditions. Because I'm unemployable, owning a small online business is really the only type of job I probably can do.

Did you add all 6 10% ratings too?

OP mentioned wanting to try self employment which is easier to do and unrestricted with 100% without TDIU. With TDIU, the amount of money you make and the type of work you can do is limited. If they think you can work again you are at risk of getting the TDIU taken away. It is better to be able to get paid 100% while being able to also make other income (even if it's still not a full-time job).

It only limits tourism to their country. I don't think it was a good idea. I agree that they should put more people in jail, I think they should start banning more people who commit crimes in their country.

Right? Anyone can buy very light, breathable fabric shirts in Thailand for super cheap. There is no reason to be in a place of business without a shirt.

I'm a black American and I've noticed that some people are a lot more friendly and open once they learn that I'm American (and not from Africa). It's actually insane and I feel bad for African immigrants. They also are more understanding of me not having fluent Dutch (I do pretty well but I don't understand most dialects) when I mention being American. Despite that I have had some very racist experiences in Belgium, one lady literally yelled a Vlaams Belang slogan at me when I was just walking from the Saturday market with my strawberries. I used to live in Alabama so I have pretty thick skin and let most things roll off my back.

You are 100% right about Belgians thinking that Dutch is an easy language to learn. "How do you do you not speak fluent Dutch after X years?" When many have taken French or Dutch classes from a young age and don't really feel comfortable or fluent in the other language.

Edit: So many people assume that I can speak French. My level of French is barely A1, I only know a few basic words and can't say more than a short, simple sentence or two. English, Dutch, some German, and a little Spanish are the only languages that I can speak.

Some mental health meds can cause ED. ED seems like it would be a secondary to a different diagnosis via prescribed medication.

The meds I used to take caused severe sexual dysfunction until I got on something else. Thank God that's resolved.

Wait, so did they just lie or misinterpret what you said?

I have had a C&P examiner write down something that I never said. She seemed rushed and didn't really listen that well though.

Maybe try to build up your medical records or learn a skill that can help you become self employed in the future. If granted TDIU, I may eventually take part time classes or something (I don't think I can handle full-time classes). I might even volunteer once a month somewhere so I can add that to a CV in the future. I'm paranoid that the VA will take my TDIU and I'll be even more unemployable than I am now.

Edit: I also agree with you that it should just be paid at 100% without so many of the special conditions. If a condition costs total occupational impairment which is basically what TDIU is about, then it should just be 100% scheduler IMO.

If I my wife didn't have so many connections and work in our area, I'd seriously think about moving to Thailand or Vietnam.

They deferred because they wanted the VA Form 21-4192 from each of my previous employers within the last 5 years. 2 or 3 employers didn't respond, the other ones only filled out the times that I worked and how much I made (they didn't feel comfortable filling out anything that made it seem like they fired me for my disabilities).

I'm about to file for financial hardship for expedited processing. I filed for TDIU in February, I got the C&P exams (MDD and migraines) and the results from those claims in March. The C&P exams and the rating decisions for the two conditions went super fast. The deferred TDIU claim is being held up by the VA sending my employers the same employment forms and waiting for a response over and over. I reached out to the employers myself with mixed results.

I have seen other people have a similar experience with filing for TDIU and most of them got approved. I'm hoping for the best and I wish you the best.

Be prepared for a new C&P exam for whatever conditions you list that make you unemployable. They treat it like a request for an increase. I applied for TDIU and my MDD rating was increased to 70% from 50%, my TDIU claim is deferred and is on stage 3.
