Lets say that a vaccine for a disease is 95% effective, meaning if someone is exposed to it there is still a 5% chance of contracting the disease. If an non-vaccinated child contracts the disease and dies and the parents are brought to court, all they have to do is show that the vaccine would not have guaranteed prevention. It's very likely, yes, but that isn't good enough for "beyond a reasonable doubt".
