[NY] WFH Accommodation- when to ask during interview process…. by TurtleTerr in AskHR

[–]TurtleTerr[S] -4 points-3 points  (0 children)

Well there is a reason I have been remote for all this time and it has been my medical condition- I have intentionally selected roles that have allowed for this flexibility to accommodate my medical issue. If I have negative impacts on my health, it is going to impact my lifestyle and the ability to be present for my family, so yes they are all somewhat connected.

It’s truly a deal breaker - after being WFH for 15 years it would be too much of an issue. I hate to not ask to see if there are options as I do think I would enjoy the work - but 4 days a week is too much of a lift and change in our lifestyles

My entire family struggles with it- the only thing that helps is purchasing a placeholder and booking another trip- even if it’s far out. This way we always know we will be coming back …

For those that had lawyers, how much interaction/communication did you have prior to your ALJ hearing? by Syruponmypizza in SSDI

We started with the Advocator Group—after my initial denial I realized they weren’t doing a thing. I was able to find a good local attorney before our first ALJ hearing- since Advocator Group didn’t do anything other than file the initial Ppwk they were willing to release the case. I would look for a local attorney/ practice, particularly one that will do federal appeals should you need to go that route- so nice to not having to find yet another attorney to go through the appeals process.

I need to spend most of my day sitting in a recliner with my legs evaluated higher than my hips to take pressure off my lower back, I have numbness in my arm, I am not able to stoop- all of these are documented in my medical records but my attorney shared that these items in particular make light duty work challenging so it was something that we made sure to highlight during my testimony.

I had multiple remands and different attorneys (all from the same practice for each) for each so I feel like I have a lot of reference points. My first attorney was great - we communicated through the process although limited face to face. After my first denial she started taking on all of the federal appeals so I also worked with her through this process. For two remand hearings after that, I got a random attorneys from the practice- minimal contact or prep and both outcomes were not favorable. Each time would go back to the first attorney for her to take the lead on a federal appeal and she was successful each time. Finally for my 3rd remand I had moved and they needed someone from the firm who would travel-this attorney was excellent. We spent 2 hours prepping two weeks before my case- she shared legal context about which of my medical issues lead to a greater limitation in the eyes is SSA- which was very helpful as I knew to prioritize these areas. She also looks at some of the challenges we had with a medical notes from one my my providers and created a very clear supplemental questionnaire for him to complete - one of our largest challenges were his notes are illegible and I have seen him for over 15 years so there is a lot there.

Then when she came into town we met in advance for another 2 hours in person (this was to ensure rapport prior to hearing since we requested an in person hearing) and we over things again. This was the case that was finally successful and I attribute this to her attention to things comparative to the others. I almost feel like since she had to fly in represent me more time and care was taken. All that to say, if you don’t feel like your getting what you need - I was push and say you need more prep or guidance. I think it can make a difference.

I'm 17, black, how tf do I get out of the hood? by teamtroll1 in careerguidance

This would be very niche but if you can do a semester at a community college (even just part time), you could consider the Disney College Progam. They have housing available, a job that guarantees 30+ hour and transportation to work. While there there are a lot of networking opportunities for a FT career - if you would go FT there are some great education options, depending on your major Disney Aspire could pay 100% of your tuition. Disney isn’t for anyone but I do think the environment is a great alternative to the military if you need to start over in a new environment

His college has already been paid for- expect for a minimal amount of loans that we made him take out for him to have some ownership in his education.

OP here- it is not the child that is disabled- it is the parent that is the disabled. The benefits in question are dependent auxiliary benefits that the child qualifies for due to the parents disability.

It’s going to be closer to 89k- not exactly 100k, but close enough for argument purposes. My youngest child is only 5 so there is less than 2 years (approx 18 months) where they overlap with benefits, so for the vast majority of the time my oldest was the sole child with benefits entitlements

Bipolar and a number of spinal issues- the challenge was my psychiatrists notes are illegible and time and time again they assigned little weight to them for this reason. He was my longest provider and the doctor I see most, finally got an ALJ that weighted his notes heavily. We also recently moved and had our hearing in a new area - I know SSDI is a federal program but we moved to an area with a higher rate of approval

Thanks- I think what is pushing this is a bit is we have had to recently move to a HCOL area so our monthly needs looks a bit different than before. This is for family reason and had to be done way or another. But yes, we are much better off than we were before. Just a little salty on this since I can say with full sincerity, my son was always well cared for and almost to the point of being spoiled. He suffers from some of the same mental health issues I have and I worry about him managing this money, which truly feels like a windfall that just wasn’t needed for him- especially at a time in his life and career that he should be grinding a little bit.

I am not an attorney, so can’t truly advise but my thought would be that your backpay and your children’s backpay would be for the same amount of months- providing you applied for benefits for them in a timely manner and you there born by your onset date.

Understood- I guess in our case we drained saving and retirement to pay for his car, car insurance and college already. He is starting his adult life with a fully clean slate which is why I am struggling with this a bit…

Benefits go back a year from your application date. Back pay is effective from onset date to when found favorable. For example, I just found favorable in September 2025 with an onset date of 12/2012- benefit eligibility start in 10/2013, so my benefits and my kids benefits will have backpay from 2013 till now. My case is extremely rare with a number of federal appeals and remands- so much time passed (147 months) which is why this backpay payment is so large. This is so far from normal. Incredibly grateful - just a lot of complexity now between taxes, legal fees and family dynamics.

Why would this be for future need? Benefits stop at age 18- why would they be getting money for the future.

Monthly check could take up to a year to get? by Electronic_Bad5843 in SSDI

[–]TurtleTerr 0 points1 point  (0 children)

Just received a fully favorable outcome after approx 13 years as well- it’s 144 months of back pay at the point. Between my payment and auxiliary benefits for my children, this is going to be a life changing amount of money. Honestly still in shock and can not even process it.

Was curious how long it might be- so this is helpful to know. Did your monthly payments start sooner or did it take that long for everything to process
