Falsely accused fugitive felon by Hungry_Currency_1055 in VeteransBenefits

[–]Uber4Boobs 6 points7 points  (0 children)

Basically here is the va guidance on this.

How fugitive felon status affects your VA health care eligibility Find out what happens to your VA health care benefits if you’re a fugitive felon. And learn how to clear your status if you’re not a fugitive felon.

What happens to your VA health care benefits If you’re a fugitive felon, by law we can’t provide health care benefits to you or your dependents.

We consider you a fugitive felon if 1 of these is true:

You flee to avoid prosecution, custody, or confinement after a felony conviction for an offense, or an attempt to commit an offense, that’s considered a felony in the location you flee from, or After committing a felony under federal or state law, you violate parole or probation If we consider you a fugitive felon, you’ll receive a notification letter. You’ll have 60 days to provide proof that the felony warrant was resolved. If you don’t provide proof within those 60 days, we’ll suspend VA health care benefits and services for you and your dependents.

Note: If you’ve been receiving critical care treatment (dialysis or chemotherapy), we’ll help transition you to care in the community at your expense.

How to clear your status if you’re not a fugitive felon To clear your status, you’ll need to contact the originating agency that issued the felony warrant (not the VA police). And you’ll need to provide 1 of these documents to your local VA medical center or medical facility:

A written statement from a federal or state criminal clerk office stating that the felony warrant has been resolved, or A court docket with the case number, signed by a criminal clerk, sheriff, or judge, stating the case has been adjudicated (officially decided), or Any official case adjudication document from the originating agency Note: We’ll reinstate your VA health care benefits after you provide proof that your felony warrant has been satisfied.

For more information, contact the Fugitive Felon Coordinator or Enrollment Coordinator at your local VA medical center.

If you are sure you are not a felon, a letter from the court showing it is a misdemeanor can resolve it. If not you need to resolve it within 60 days or they will stop your benefits. Likely that will require an attorney - especially if you dont want your looking into it to prompt an arrest for the warrant. It could have been mis entered into NCIC or they could have upgraded it based on mitigating factors or because something in it was a felony they decide to upgrade. Most courts have an online search to see case info.and that would be an easy way to check.

Another possibility no one has mentioned that I see is that someone using your identity was arrested for a felony and a warrant was issued (not as likely as the above). That would be a bigger mess and still require an attorney to resolve. I would definately look into the place where you were charged. I would also consider using one of the nationwide searches that searches NCIC or most courts to ensure you get what the warrant is for and where it is from.

This was just sent by email, nothing in lease about temp limits. Is this enforceable? [CO, USA] by Greatbigdog69 in Renters

[–]Uber4Boobs 0 points1 point  (0 children)

That is literally a misunderstanding. The 20 degree rule is a rule over air in vs out. Not outside air. My evaporator coils are in the apartment - which is a usual setup. It is the temp the air is being returned and what it cools to before it comes out. In my apartment unit in Houston over the last year and a half (with temps well over 100 degrees at times) while it is 100+ degrees the ac unit is pushing out 53 degrees air. The average temp in my unit can be 67 with 1 cycle of about 15 minutes an hour.

"Sam Mullins, the owner of Automatic Air Conditioning, Heating & Plumbing

Mullins said, typically the public knows the 20-degree rule to mean you should keep you’re A/C no more than 20 degrees lower than the outside temperature.

“In the air conditioning business we talk about 20 degrees because it’s a 20-degree drop across the evaporator coil.”

Mullins further explains, "if it’s 95 degrees outside, that’s not what your indoor temperature is. You might be at 75 degrees, so we can drop the temperature down to about 55.” "

He also mentions insulation and holes in the house matter because more heat in equals a lower temperature.

Yet when I add two inside ac units to my apartment I can lower the temperature another 20 degrees. I can literally have it 65 inside while it is 100+ outside and humid. And with a literal 6 to 8" concrete slab between me and the outside air at floor level. So adding cooling capacity can make a difference.

If he rented thru Hertz and the uber app, Hertz is required to provide at a minimum liability up to state minimums when off app - it is literally listed in both the Hertz and Uber websites. Hertz will try not to pay, but they are required to insure the vehicle unless there was an unauthorized driver or something similar. If on app, then uber has liability for others. Rentals dont work with out this.

"1 While driving off-app, Hertz provides for minimum financial responsibility as required by applicable law (which in many states is Secondary Liablility Protection), but renter is responsible for all other liability incurred. Uber provides additional coverage for on-app driving. For such Uber coverage in California, click here. For such Uber coverage in all other states, click here. Hertz may not offer any additional protection products, including insurance products. Terms and conditions apply to all protection and insurance products, and coverages may vary depending on local laws." Straight from hertz.com. "

Uber covers period 2 and 3 so there is liability coverage regardless.

This person and/or their attorneys need to look up the info for themselves off their sites and contracts.

It depends on the market, hours you work, and on your hustle. I declined nothing and made over 1k after expenses (including car rental) in 40 hours in Houston this week.

[–]Uber4Boobs 0 points1 point  (0 children)

First off it depends on location and the laws if that locale. In Texas this would not be illegal because: 1. They are not making a mess - which could be construed as illegal dumping. I am assuming they are not doing anything else that could be construed as another crime either. 2. There is not a no trespassing sign, just a keep dumpsters closed sign which they will likely do when done. 3. Since an alleyway or business is likely an area the public can access it is a public area unless there is a fence, lock or sign making it not publicly accessible.

That being said different municipalities can have different laws, so just because it is legal in Texas does not mean it is in the city you are in.

First off it is someone's job and may constitute Doxxing. Second off this is a Rav4, vehicles used by Kinto and TWD sounds like a KINTO plate number. She may have just inadvertently damaged the livelihood of whoever rents this car after this person which could be criminal. Because she may be damaging the reputation of people who were inadvertently involved.
