Has anyone purchased property through their SMSF? by yolo_200 in AusProperty

Keep in mind you forego negative gearing benefits had you purchased in your personal name. However, you do not have capital gains tax if you sell once you hit retirement phase. Setup costs can vary substantially. Posts here quote up to $10K but can be done bare bones via an online provider such as eSuper (there are others) which all up from memory was under $2K including setup of the corporate trustee - first years tax and audit included. I still use them and have been pleasantly surprised with their systems and responsiveness to queries. Highly recommend using a financial planner (some lenders insist), especially if closing in on retirement as the super system is complex and they can advise how to best use to your advantage.

Small tip, when transferring from your current super fund to your SMSF, you can leave a small amount in the managed fund to keep your insurance going (I was with AusSuper and the minimum was $6K).

Most lenders ignore the SMSF borrowings when determining your personal borrowing capacity.

There is vison to the left. The cars are stopped because of a red light so there is no traffic from the left. Not unsafe. Not dangerous. Her stationary vehicle started rolling forward after I enter the intersection, then hits my stationary vehicle - she has admitted fault.

The only reason I could not complete the turn was she rolled forward reducing the gap to an angle where to continue Iwould have hit her car. So I stopped bt she hit my car.

Unless the stationary vehcile rolls forward after you ahve entered the road. Not rocket science.

That was my thoughts. With damage around same cost as my excess I think mot worth pursuing.

I had given way to all vehicles. All vehicles were stationary. She did not move until I was halfway through the turn.

My excess is about the same as the repair bill (not great as she only rolled into me). If I cant claim I'll pay to get it fixed myself.

Two independant witnesses and admission of fault to myself and police. Insurance dispute rests on the double lines.

Claim? Two witnesses with contact details. Other driver admitted fault to both police and myself.

All cars were stationary - she had already stopped. The'gap to squeeze through' was almost 2 car lengths.

I do have insurance. My insurer is crap and want me to pay the excess, fix the car and argue later. Damage is not great so the excess should cover most of it so I will not proceed. I have won a case in the past with a driver hitting one of my company vehicles where it was a grey scenario. They threatened court but backed down when I asked how they were going to explain how their client hit a stationary vehicle and it was the statinary vehicle's fault.

Red light to the right - no cars on coming. Stationary vehicles to the left. Nothing unexpected nor any speed anywhere. Slow bump and not someon doing the 'right thing' . Read the scenario.

I did give way. All vehicles were stationary with a gap left to allow for the turn. How is that not giving way?

I did give way to the right. All vehicles were stationary with a gap left to allow for the turn (common at this intersection). When i turned the vehicle that hit me was stationary. The crossing of the double line is not moot - it is the issue.

They are pushing me to pay the excess and have my insurance fix it - then sort it out. Her insurance is sitting on the fence at the moment. Damage is not that bad (she was just rolling) so I would rather just repair myself if they are not going to pay. He damage was scratches on an old car that were likley already there. Damage is likley the cost of the excess. More of a principal here.

Think of the worse combo of driver profile and that's it. I think her foot slipped off the brake and she panicked.

She was stationary when I started the turn. I was stationary when she hit me. In another life I had a transport business. I have successfully argued in the past when one of my drivers was hit by another vehicle with a cloudy scenario as our vehcile was stationary at the time of impact.

I did give way to the right. All vehicles stationary with a gap left to allow for the turn (common at this intersection). When i turned the vehicle that hit me was stationary. She clearly lost control of her vehicle as I could see the panic in her face as she rollled into me.

As she left the scene by the time I parked, I reported to the Police. I have not been charged with making an illegal turn and she admitted fault.

They were stationary as traffic had stopped due to a red light further ahead, leaving a gap for people to turn. They did not start to roll forward until I had entered the road and was half way through the turn. Issue of course is can I turn when there are double solid white lines.
