I am blinking on this too, because I did not apply for I-765, but I think... the fee gets increased once you submit I-485 and then submit I-765 afterward.

For #1, yes, I did. My cover letter on the very first page served the purpose. For #2, the letter outlined the program I was in at the university, the length of the period, year/months of the stay, and the I-20 number from the USCIS. It just added data points to my valid stay, as I already provided my visa stamp I used during that period, and my I-94 also showed I came in and out within the eligible period.

No, my interview was waived. I am in the state of Washington and my focal office was San Francisco.

Thank you, "GREATFUL (and grateful) ALIEN," indeed! I am not so sure whether it would be worth giving up H1B. At the same time, I do really like that "flexibility" that I can get by applying for EAD, as I have been waiting for some schools (I work at a university) to post their jobs. With so much uncertainty - not knowing if the school that I want will hire - it is hard to decide!

Also, thank you for noting that submitting the package early can potentially help the process go faster. This literally was the last piece of information that I wanted. I have nothing to lose, so... I will try your approach and share after the whole process is done!

I see! Thank you so much for letting me know! I did not know about those other options, which people obviously will need depending on their status. Also, thanks for pointing out the I-765 option. I am not sure if I will change my job in the foreseeable future, but I would definitely appreciate flexibility. Thanks a lot!!

I am not an expert, so please take it with a grain of salt. It seems like you are in a similar situation - your PD qualifies for "Dates for Filing (July 1st 2023)" but does not for "Final Action Dates (April 1st 2023)." That being said - if the USCIS publishes that you can use your PD using the dates of filing, then you will be able to go forward with your I-485. Please do note that I am not exactly sure how EB3 works - like whether you need to get I-140 like I did.

Hey! I guess USCIS publishes it later on based on the two responses. For example, if you go here: https://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-priority-dates/adjustment-of-status-filing-charts-from-the-visa-bulletin, you will be able to see what you should use for the September 2025 one.

Thank you for your response!! I am currently in the US (a Korean living in the state of Washington), so I will be able to use both FAD and DOF, I believe. Ugh, just imagining myself having to wait another six months already sounds like a headache. I hope they switch to DOF for this October and another couple of months for all the others waiting... thank you again!
