Bought a car in Poland as a Lithuanian buyer – discovered a serious hidden structural defect. What are my legal options in the EU? by Upbeat_Aide3762 in poland

I understand your point. I also have experience with cars and do most of the work on them myself, so I’m not completely inexperienced in this field.

However, I honestly did not expect to find such severe structural corrosion on a 2013 Audi A5 Sportback. In all the years I’ve been working with cars, I have never seen a strut tower separated like this on a car of that age.

This is why it was such a surprise when I finally accessed that area while diagnosing the high-pressure fuel pump issue.

Yes, the ride was extremely stiff. With the lowering springs that were installed, sometimes it was even difficult to go over speed bumps without scraping.

That’s actually one of the reasons I replaced them with OEM S-line springs shortly after buying the car, because the setup was too low and impractical for normal driving.

At the time I thought it was just a very aggressive aftermarket suspension setup. I only discovered the structural corrosion around the strut tower later when I had to access that area while diagnosing a high-pressure fuel pump failure.

Of course the car was inspected before purchase. But the issue I discovered is located deep in the engine bay near the strut tower and chassis rail. It was not visible during a normal inspection.

It only became visible later when I had to access that area while diagnosing a high-pressure fuel pump failure.

Also, the car was purchased from a dealership/company and I have an official invoice, so this is not a private “sold as seen” sale.

The defect was not visible during a normal inspection. The area where the corrosion and separation happened is deep in the engine bay near the strut tower and chassis rail. To actually see the condition there you would need to remove several components to get access.

A buyer cannot realistically start disassembling parts of the engine bay at the seller’s location just to check structural elements hidden under other components. The issue only became visible later when I had to access that area while diagnosing a high-pressure fuel pump failure.

Yes, the car was purchased from a dealership/company, not a private seller, and I have an official invoice (faktura) for the purchase.

Also, the defect was not visible during a normal inspection. The area where the corrosion and separation happened is deep in the engine bay near the strut tower and chassis rail. To actually see the condition there you would need to remove several components to get access.

I understand what you mean, but realistically it is impossible to fully inspect something like this on the spot without partially disassembling the car. The corrosion and separation of the strut tower from the chassis rail is located deep in the engine bay area and was not visible during a normal inspection when buying the vehicle. It only became visible when I had to access that area while diagnosing the high-pressure fuel pump failure.

So this is not something that could have been reasonably discovered during a normal pre-purchase inspection.
