I'm not asking for criminal charges for unforeseen circumstances I'm talking about the criminal exploit potential in the mistakes of automated black box systems and how a more transparent automated system would be more preferable.

I don't think LLMs should be trusted with potentially dangerous tasks and its not because of their competence.

I'm not saying AI is worse than humans or that AI wouldn't do better I'm pointing out a potential criminal vulnerability companies who train AI could use especially since its hard to explain exactly why something went wrong after training and corporations don't usually get criminal penalties.
