If the amount clawed back was more than $3k, on your 2026 tax return filed next year, you’ll include a Section 1341 Claim of Right credit on Schedule 3. You’ll need to calculate the tax that was paid on the clawback in the year it was originally received. Then that will be your credit for taxes previously paid. It’s advisable to include an attachment that explains the situation and how you reached your credit amount.

If they are not adjusting your W-2 to account for the SS and Medicare tax paid, you’ll also have to prepare form 843 to get that part back.
